1 A bill to be entitled
2 An act relating to boiler safety; repealing s.
3 554.106, F.S., which requires the Department of
4 Insurance to employ deputy inspectors under ch.
5 554, F.S., the Boiler Safety Act; amending s.
6 554.105, F.S., to conform; amending s. 554.108,
7 F.S., to conform; providing that each
8 inspection of a boiler under the Boiler Safety
9 Act shall be conducted by a special inspector;
10 amending s. 554.111, F.S.; eliminating
11 certificate inspections and other specified
12 inspections conducted by the department and
13 fees therefor; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. Section 554.106, Florida Statutes, is
18 repealed.
19 Section 2. Paragraph (d) of subsection (2) of section
20 554.105, Florida Statutes, is amended to read:
21 554.105 Chief inspector.--
22 (2) The department, through the chief inspector, shall
23 administer the state boiler inspection program, and shall:
24 (d) Expend funds necessary to meet the expenses
25 authorized by ss. 554.1011-554.115, including the necessary
26 travel expenses of the chief inspector and deputy inspectors,
27 and the expenses incident to the maintenance of his or her
28 office.
29 Section 3. Subsections (2), (4), and (5) of section
30 554.108, Florida Statutes, are amended to read:
31 554.108 Inspection.--

1 (2) Each inspection of a boiler conducted pursuant to
2 ss. 554.1011-554.115 shall be made by the chief inspector, a
3 deputy inspector, or a special inspector.
4 (4) Deputy inspectors and Special inspectors shall
5 file a written report on each certificate inspection with the
6 chief inspector within 15 days following such inspection. The
7 filing of reports of inspections other than certificate
8 inspections are not required unless such inspections disclose
9 that a boiler is in an unsafe condition.
10 (5) Upon determining that a boiler is in an unsafe
11 condition and poses an imminent danger to the public health,
12 safety, and welfare, the chief inspector, a deputy inspector,
13 or a special inspector may immediately order the boiler to be
14 shut down. The boiler shall remain shut down until a
15 reinspection by a certified inspector determines that all
16 violations have been corrected, that the boiler may be
17 operated safely, and that a certificate of compliance has been
18 issued.
19 Section 4. Section 554.111, Florida Statutes, is
20 amended to read:
21 554.111 Fees.--
22 (1) The department shall charge the following fees:
23 (a) For an applicant for a certificate of competency,
24 the initial application fee shall be $50, and the annual
25 renewal fee shall be $30. The fee for examination shall be
26 $50.
27 (b) For certificate inspections conducted by the
28 department:
29 1. For power boilers and high pressure, high
30 temperature water boilers of:
31 4,000 square feet or less

19 (2) Not more than an amount equal to one certificate
20 inspection fee shall be charged or collected for any and all
21 boiler inspections in any inspection period, except as
22 otherwise provided in ss. 554.1011-554.115.
23 (a) When it is necessary to make a special trip to
24 observe the application of a hydrostatic test, an additional
25 fee equal to the fee for a certificate inspection of the
26 boiler shall be charged.
27 (b) All other inspections, including shop inspections,
28 surveys, and inspections of secondhand boilers made by the
29 chief inspector or a deputy inspector, shall be charged at the
30 rate of not less than $270 for one-half day of 4 hours, and

1 $500 for 1 full day of 8 hours, plus travel, hotel, and
2 incidental expenses in accordance with chapter 112.
3 (3) The chief inspector shall deposit all fees
4 received pursuant to ss. 554.1011-554.115 into the Insurance
5 Commissioner's Regulatory Trust Fund.
6 Section 5. This act shall take effect July 1, 2001.

9 HOUSE SUMMARY

Repeals provisions which require the Department of
11 Insurance to employ deputy inspectors under ch. 554,
F.S., the Boiler Safety Act, and conforms provisions
12 accordingly. Provides that each inspection of a boiler
under the Boiler Safety Act shall be conducted by a
13 special inspector. Eliminates certificate inspections and
other specified inspections conducted by the department
14 and fees therefor.
