2 An act relating to community care for the
3 elderly; amending s. 430.203, F.S.; redefining
4 the term "lead agency"; removing the
5 requirement of mandatory case management;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (9) of section 430.203, Florida
11 Statutes, is amended to read:
12 430.203 Community care for the elderly;
13 definitions.--As used in ss. 430.201-430.207, the term:
14 (9) "Lead agency" means an agency designated at least
15 once every 3 years by an area agency on aging as the result of
16 a request for proposal process as provided in s. 287.057 to be
17 in place no later than the state fiscal year 1996-1997.
18 (a) The guidelines for the request for proposal must
19 be developed by the department in consultation with the area
20 agencies on aging. Such guidelines must include requirements
21 for the assurance of quality and cost-efficiency of services,
22 minimum personnel standards, and employee benefits.
23 (b) The area agency on aging, in consultation with the
24 department, may exempt from the competitive bid process any
25 contract with a provider who meets or exceeds established
26 minimum standards, as determined by the department.
27 (c) In each community care service system the lead
28 agency must be given the authority and responsibility to
29 coordinate some or all of the services, either directly or
30 through subcontracts, for functionally impaired elderly
31 persons. These services must include case management and may

1 include case management, homemaker and chore services, respite
2 care, adult day care, personal care services, home-delivered
3 meals, counseling, information and referral, and emergency
4 home repair services. The lead agency must compile community
5 care statistics and monitor, when applicable, subcontracts
6 with agencies providing core services.
7 Section 2. This act shall take effect July 1, 2001.
