2 An act relating to unemployment compensation;
3 amending s. 443.036, F.S.; providing a
4 definition and an application of an alternative
5 base period; providing requirements and
6 limitations; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (7) of section 443.036, Florida
11 Statutes, is amended to read:
12 443.036 Definitions.--As used in this chapter, unless
13 the context clearly requires otherwise:
14 (7) BASE PERIOD.--
15 (a) "Base period" means the first four of the last
16 five completed calendar quarters immediately preceding the
17 first day of an individual's benefit year.
18 (b) With respect to a benefit year commencing after
19 January 1, 2002, if an individual is not monetarily eligible
20 in his or her base period to qualify for benefits, the
21 division must designate his or her base period to be the
22 alternative base period. As used in this paragraph, the term
23 "alternative base period" means the last four completed
24 calendar quarters immediately preceding the individual's
25 benefit year. Wages used in a base period to establish a
26 monetarily eligible benefit year may not be applied to
27 establish monetary eligibility in any succeeding benefit year.
28 If information regarding wages for the calendar quarter or
29 quarters immediately preceding the benefit year is not
30 available to the division from the regular quarterly reports
31 of wage information, the division shall request such

1 information from the employer. An employer must respond to a
2 wage request from the division within 10 days.
3 Section 2. This act shall take effect October 1, 2001.

7 Provides for use of an alternative base period whenever
an individual is not monetarily eligible in a base period
8 to receive unemployment compensation benefits.
