  1                      A bill to be entitled

  2         An act relating to construction contracts;

  3         amending s. 725.06, F.S.; revising provisions

  4         relating to indemnification on construction

  5         contracts; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Subsection (2) of section 725.06, Florida

10  Statutes, is amended to read:

11         725.06  Construction contracts; limitation on

12  indemnification.--

13         (2)  Except as specifically provided in subsection (1),

14  a construction contract entered into with a public agency may

15  not require that the other one party defend, to indemnify, or

16  hold harmless the agency other party, its employees, officers,

17  directors, or agents from any liability, damage, loss, claim,

18  action, or proceeding arising from the agency's own

19  negligence, and any such contract provision is void as against

20  the public policy of this state.

21         Section 2.  This act shall take effect upon becoming a

22  law.
