2 An act relating to the Department of
3 Environmental Protection; directing the
4 Department of Environmental Protection and the
5 State Technology Office to establish a pilot
6 project to test the cost-effectiveness of
7 publication of notices on the Internet in lieu
8 of publication in the Florida Administrative
9 Weekly; directing the Department of State to
10 publish notice of the pilot project; requiring
11 the Department of Environmental Protection, the
12 State Technology Office, and the Department of
13 State to submit a joint report on the
14 cost-effectiveness of publication of such
15 notices on the Internet; providing an effective
16 date.

18 Be It Enacted by the Legislature of the State of Florida:

20 Section 1. (1) On or before December 31, 2001, the
21 Department of Environmental Protection and the State
22 Technology Office of the Department of Management Services
23 shall establish and commence a pilot project to determine the
24 cost-effectiveness of publication of notices on the Internet
25 in lieu of publication in the Florida Administrative Weekly.
26 The pilot project shall end on July 1, 2003. Under this pilot
27 project, notwithstanding any other provision of the Florida
28 Statutes, whenever the Department of Environmental Protection
29 is required to publish notices in the Florida Administrative
30 Weekly, in lieu of publication in the Florida Administrative
31 Weekly, the Department of Environmental Protection shall

1 publish such notices on the Internet. Notices published on the
2 Internet under this provision shall clearly state the date the
3 notice was first posted on the Internet, shall be posted only
4 on the same days the Florida Administrative Weekly is
5 published, and shall comply with the form and content
6 provisions of rules 1S-1.002-1S-1.004, Florida Administrative
7 Code. Notices related to rulemaking published on the Internet
8 under this provision shall be maintained on the Internet for a
9 period of 12 months after the effective date of the rule or 3
10 months after the publication of a notice of withdrawal of the
11 proposed rule. All other notices published on the Internet
12 under this provision shall be maintained on the Internet for a
13 period of 3 months after the date first posted. The pilot
14 project shall also establish a searchable database or other
15 electronic system to be permanently maintained on the Internet
16 for the purpose of archiving all notices published on the
17 Internet and allowing citizens permanent electronic access to
18 such archived records.
19 (2) The Department of State shall publish notice of
20 this pilot project in each weekly publication of the Florida
21 Administrative Weekly. The notice shall state: "Under a
22 temporary pilot project, in conjunction with the State
23 Technology Office, to determine the cost-effectiveness of
24 Internet publication of notices in lieu of publication in the
25 Florida Administrative Weekly, notices of the Department of
26 Environmental Protection are being published on the Internet
27 at the following Internet URL or address:
28 http://www.dep.state.fl.us."
29 (3) No later than January 31, 2003, the Department of
30 Environmental Protection, the State Technology Office, and the
31 Department of State shall submit a report to the Governor, the

1 President of the Senate, and the Speaker of the House of
2 Representatives containing findings on the cost-effectiveness
3 of publication of notices on the Internet in lieu of
4 publication in the Florida Administrative Weekly, and
5 recommendations, including legislative or rule changes, for
6 modifications to the process necessary to effectuate
7 publication of notices on the Internet.
8 Section 2. This act shall take effect July 1, 2001.

Directs the Department of Environmental Protection and
13 the State Technology Office of the Department of
Management Services to establish a pilot project to
14 determine the cost-effectiveness of publication of
notices on the Internet rather than in the Florida
15 Administrative Weekly. Directs the Department of State to
publish weekly notices of the pilot project in the
16 Florida Administrative Weekly. Requires the Department of
Environmental Protection, the State Technology Office,
17 and the Department of State to submit a report to the
Governor and Legislature by January 31, 2003.
