15 On page 10, line 5, through page 12, line 23, delete
16 those lines

18 and insert:
19 (10) CITIZEN APPEAL.--
20 (a) If the school board fails to vote whether to adopt
21 an action plan for implementation or the school district fails
22 to implement the action plan after voting to implement the
23 action plan, any citizen who is a resident of the district may
24 submit a written appeal to the State Board of Education.
25 (b) An appeal on the grounds that the school district
26 has failed to vote whether to adopt an action plan may be
27 filed not less than 90 days following the school district
28 receipt of the audit report.
29 (c) An appeal on the grounds that the school district
30 has failed to implement the action plan may be filed not less
31 than 180 days following the receipt of the audit report.

1 (d) The State Board of Education must, by majority
2 vote, accept or reject the decision of the district school
3 board no later than 60 days after an appeal is filed. The
4 State Board of Education shall remand the appeal to the
5 district school board with its written recommendations for
6 district school board actions.
7 (e) Upon receipt and evaluation of the appeal, the
8 Commissioner of Education may contact the school district,
9 assess the situation, urge the school district to commence
10 implementation, and offer technical assistance, if needed.
