2 An act relating to dentistry; amending s.
3 627.419, F.S.; providing for appeals from
4 certain adverse determinations relating to
5 dental service claims; amending s. 456.031,
6 F.S.; providing an alternative by which
7 licensees under ch. 466, F.S., may comply with
8 a general requirement that they take
9 domestic-violence education courses; amending
10 s. 456.033, F.S.; providing an alternative by
11 which such licensees may comply with a general
12 requirement that they take AIDS/HIV education
13 courses; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. Subsection (3) of section 456.031, Florida
18 Statutes, is amended to read:
19 456.031 Requirement for instruction on domestic
20 violence.--
21 (3)
22 (a) In lieu of completing a course as required in
23 subsection (1), a licensee or certificateholder may complete a
24 course in end-of-life care and palliative health care, if the
25 licensee or certificateholder has completed an approved
26 domestic violence course in the immediately preceding
27 biennium.
28 (b) In lieu of completing a course as required by
29 subsection (1), a person licensed under chapter 466, who has
30 completed an approved domestic-violence education course in

1 the immediately preceding 2 years may complete a course
2 approved by the Board of Dentistry.
3 Section 2. Subsection (9) of section 456.033, Florida
4 Statutes, is amended to read:
5 456.033 Requirement for instruction for certain
6 licensees on human immunodeficiency virus and acquired immune
7 deficiency syndrome.--
8 (9)(a) In lieu of completing a course as required in
9 subsection (1), the licensee may complete a course in
10 end-of-life care and palliative health care, so long as the
11 licensee completed an approved AIDS/HIV course in the
12 immediately preceding biennium.
13 (b) In lieu of completing a course as required by
14 subsection (1), a person licensed under chapter 466 who has
15 completed an approved AIDS/HIV course in the immediately
16 preceding 2 years may complete a course approved by the Board
17 of Dentistry.
18 Section 3. Subsection (9) is added to section 627.419,
19 Florida Statutes, to read:
20 627.419 Construction of policies.--
21 (9) With respect to any group or individual insurer
22 covering dental services, each claimant, or dentist acting for
23 a claimant, who has had a claim denied as not medically or
24 dentally necessary or who has had a claim payment based on an
25 alternate dental service in accordance with accepted dental
26 standards for adequate and appropriate care must be provided
27 an opportunity for an appeal to the insurer's licensed dentist
28 who is responsible for the medical necessity reviews under the
29 plan or is a member of the plan's peer review group. The
30 appeal may be by telephone, and the insurer's dentist must

1 respond within a reasonable time, not to exceed 15 business
2 days.
3 Section 4. This act shall take effect July 1, 2001,
4 and section 3 of this act, amending section 627.419, Florida
5 Statutes, shall apply to policies issued or renewed after that
6 date.
