17 Section 7. In order to implement Specific
18 Appropriation 118 of of the 2001-2002 General Appropriations
19 Act, subsection (8) of section 229.57, Florida Statutes, is
20 amended to read:
21 229.57 Student assessment program.--
22 (8) DESIGNATION OF SCHOOL PERFORMANCE GRADE
23 CATEGORIES.--For purposes of determining school performance,
24 student performance should be based on a student's annual
25 learning gains when the gain can be measured with an accurate
26 and consistent assessment system. Currently, the statewide
27 assessment system cannot measure a year's worth of knowledge
28 because not all grades are tested and there is not sufficient
29 data to create a baseline to measure improvement. Therefore,
30 it is the intent of the Legislature that an alternative system
31 should be created until 2 years of assessment data are

1 available to start measuring actual student learning gains.
2 School performance grade category designations itemized in
3 subsection (7) shall be based on the following:
4 (a) Timeframes.--
5 1. School performance grade category designations
6 shall be based on one school year of performance.
7 2. In school years 1998-1999 and 1999-2000, a school's
8 performance grade category designation shall be determined by
9 the student achievement levels on the FCAT, and on other
10 appropriate performance data, including, but not limited to,
11 attendance, dropout rate, school discipline data, and student
12 readiness for college, in accordance with state board rule.
13 3. In the 2000-2001 school year, a school's
14 performance grade category designation shall be determined as
15 follows: based on a combination of student achievement scores
16 as measured by the FCAT, on the degree of measured learning
17 gains of the students, and on other appropriate performance
18 data, including, but not limited to, dropout rate and student
19 readiness for college.
20 a. Elementary schools.--
21 (I) Sixty percent of the performance grade shall be
22 derived from a composite of the FCAT scores for grades 4 and
23 5, and the percentage of kindergarten through grade 2 classes
24 for which there is a ratio of one teacher to twenty students.
25 (II) Twenty percent of the performance grade shall be
26 derived from an assessment by the school advisory committee of
27 the progress toward the goals of the school improvement plan.
28 (III) Twenty percent of the performance grade shall be
29 derived from an assessment of parental involvement and school
30 safety programs and initiatives, to be weighted at ten percent
31 each.

1 b. Middle schools.--
2 (I) Sixty percent of the performance grade shall be
3 derived from the grade 8 FCAT scores.
4 (II) Twenty percent of the performance grade shall be
5 derived from an assessment by the school advisory committee of
6 the progress toward the goals of the school improvement plan.
7 (III) Twenty percent of the performance grade shall be
8 derived from an assessment of parental involvement and school
9 safety programs and initiatives, to be weighted at ten percent
10 each.
11 c. High schools.--
12 (I) Sixty percent of the performance grade shall be
13 derived from a composite of the grade 10 FCAT scores, and the
14 school's overall dropout and graduation rate, which shall be
15 weighted at thirty percent each.
16 (II) Twenty percent of the performance grade shall be
17 derived from an assessment by the school advisory committee of
18 the progress toward the goals of the school improvement plan.
19 (III) Twenty percent of the performance grade shall be
20 derived from an assessment of parental involvement and school
21 safety programs and initiatives, to be weighted at ten percent
22 each.
23 In order to implement subparagraph 3., the Department of
24 Education shall determine and disseminate the standardized
25 method by which school advisory committees shall make their
26 assessments pursuant to this subparagraph and the department
27 shall determine a process for submission of documentation and
28 standards for assessment of parental involvement, school
29 safety, and bonus point factors.
30 4. Beginning with the 2001-2002 school year and
31 thereafter, a school's performance grade category designation

1 shall be based on student learning gains as measured by annual
2 FCAT assessments in grades 3 through 10, and on other
3 appropriate performance data, including, but not limited to,
4 dropout rate, cohort graduation rate, and student readiness
5 for college.
6 (b) Student assessment data.--Student assessment data
7 used in determining school performance grade categories shall
8 include:
9 1. The median scores of all eligible students enrolled
10 in the school who have been assessed on the FCAT.
11 2. The median scores of all eligible students enrolled
12 in the school who have been assessed on the FCAT and who have
13 scored at or in the lowest 25th percentile of the state in the
14 previous school year.

16 The Department of Education shall study the effects of
17 mobility on the performance of highly mobile students and
18 recommend programs to improve the performance of such
19 students. The state board shall adopt appropriate criteria for
20 each school performance grade category. The criteria must also
21 give added weight to student achievement in reading. Schools
22 designated as performance grade category "C," making
23 satisfactory progress, shall be required to demonstrate that
24 adequate progress has been made by students who have scored
25 among the lowest 25 percent of students in the state as well
26 as by the overall population of students in the school.
27 Section 8. The amendment of subsection (8) of section
28 229.57, Florida Statutes, by this act shall expire on July 1,
29 2002, and the text of said subsection shall revert to that in
30 existence on June 30, 2001, except that any amendments to such
31 text enacted other than by this act shall be preserved and

1 continue to operate to the extent that such amendments are not
2 dependent upon the portions of said text which expire pursuant
