1 A bill to be entitled
2 An act creating the Technology Enterprise
3 Operating Trust Fund; carrying forward current
4 balances and continuing current sources and
5 uses thereof; providing a contingent effective
6 date.

8 WHEREAS, the Legislature recognizes the need for
9 strategic investment in information technology to deliver
10 services to the public, and
11 WHEREAS, the Legislature recognizes information and
12 information technology as a strategic asset of the state which
13 should be managed as a valuable state resource, and
14 WHEREAS, the Legislature wishes to deploy information
15 technology in a cost-effective and efficient manner, and
16 WHEREAS, the Legislature has found a public policy for
17 establishing one operating trust fund for information
18 technology operations, NOW, THEREFORE,

20 Be It Enacted by the Legislature of the State of Florida:

22 Section 1. The Technology Enterprise Operating Trust
23 Fund is created in the State Technology Office in the
24 Department of Management Services pursuant to section 19(f),
25 Article III of the State Constitution.
26 Section 2. All current balances of the Communications
27 Working Capital Trust Fund and the Working Capital Trust Fund
28 in the Department of Management Services, and all current
29 sources and uses of the trust fund, are transferred to the
30 Technology Enterprise Operating Trust Fund (72 2621).

1 Section 3. Notwithstanding the provisions of section
2 216.301, Florida Statutes, and under the provisions of section
3 216.351, Florida Statutes, any balance in the trust fund at
4 the end of any fiscal year shall remain in the trust fund at
5 the end of the year and shall be available for carrying out
6 the purposes of the trust fund.
7 Section 4. In accordance with section 19(f)(2),
8 Article III of the State Constitution, the Technology
9 Enterprise Operating Trust Fund of the Department of
10 Management Services shall, unless terminated sooner, be
11 terminated on July 1, 2005. Before its scheduled termination,
12 the trust fund shall be reviewed as provided in section
13 215.3206(1) and (2), Florida Statutes.
14 Section 5. This act shall take effect July 1, 2001,
15 but it shall take effect only if it is enacted by a
16 three-fifths vote of the membership of each house of the
17 Legislature.

21 Creates the Technology Enterprise Operating Trust Fund in
the State Technology Office of the Department of
22 Management Services and provides sources of funding.
Provides for carryover of unexpended funds. Terminates
23 the fund after 4 years.
