6 providing for sources of funds and purposes;
7 providing for creation of a reserve account;
8 providing for annual carryforward of funds;
9 providing for future review and termination or
10 re-creation of the trust fund; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Section 282.20, Florida Statutes, is
16 amended to read:
17 282.20 Technology Resource Center.--
18 (6) Notwithstanding the provisions of s. 216.272, the
19 Technology Resource Center may spend the funds in the reserve
20 account of the Technology Enterprise Operating Trust Fund its
21 working capital trust fund for enhancements to center
22 operations or for information technology resources. Any
23 expenditure of reserve account funds must be approved by the
24 Chief Information Officer of the State Technology Office. Any
25 funds remaining in the reserve account at the end of the
26 fiscal year may be carried forward and spent as approved by
27 the Chief Information Officer of the State Technology Office,
28 provided that such approval conforms to any applicable
29 provisions of chapter 216.
30 Section 2. Section 282.23, Florida Statutes, is
31 created to read:

1 282.23 Technology Enterprise Trust Fund.--
2 (1) The Technology Enterprise Trust Fund is created
3 within the Department of Management Services.
4 (2) Funds to be credited to the trust fund shall
5 consist of service charges for the state's telecommunications
6 system and data processing services and shall include interest
7 earnings. Funds shall be used for the purpose of operating the
8 state's telecommunications system and the data processing
9 center in the State Technology Office of the Department of
10 Management Services.
11 (3) In order to operate the data processing center,
12 the State Technology Office may create a reserve account
13 within the trust fund to pay for future information technology
14 resource acquisitions as appropriated by the Legislature. The
15 funds in such account shall be provided from moneys budgeted
16 for data processing services and equipment by those agencies
17 to be served by the data processing center.
18 (4) Each agency served by the State Technology Office
19 shall contribute an amount equal to its proportionate share of
20 the cost of operations. Each agency utilizing the services of
21 the State Technology Office shall pay for such services on a
22 quarterly basis or such other basis as may be determined by
23 the Executive Office of the Governor.
24 (5) Notwithstanding the provisions of s. 216.301 and
25 pursuant to s. 216.351, any balance in the trust fund at the
26 end of any fiscal year shall remain in the trust fund at the
27 end of the year and shall be available for carrying out the
28 purposes of the trust fund.
29 (6) Pursuant to the provisions of s. 19(f)(2), Art.
30 III of the State Constitution, the trust fund shall, unless
31 terminated sooner, be terminated on July 1, 2005. Prior to its

1 scheduled termination, the trust fund shall be reviewed as
2 provided in s. 215.3206(1) and (2).
3 Section 3. This act shall take effect July 1, 2001.

8 Renames working capital trust fund as the Technology
Enterprise Operating Trust Fund in subsection (6) of section
9 282.20, Florida Statutes.
10 Provides that funds in trust fund will be used for operating
the state's telecommunications system and the data processing
11 center in the State Technology Office.
12 Requires each agency served by the State Technology Office to
contribute an amount equal to its share of the operations on a
13 quarterly basis.
