  1                      A bill to be entitled

  2         An act relating to the regulation of public

  3         utilities; amending s. 367.011, F.S.; providing

  4         that the regulation of public utilities must

  5         ensure that monopoly services are subject to

  6         effective price, rate, and service regulation;

  7         providing an effective date.

  8

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Section 367.011, Florida Statutes, is

12  amended to read:

13         367.011  Jurisdiction; legislative intent.--

14         (1)  This chapter may be cited as the "Water and

15  Wastewater System Regulatory Law."

16         (2)  The Florida Public Service Commission shall have

17  exclusive jurisdiction over each utility with respect to its

18  authority, service, and rates.

19         (3)  The regulation of utilities is declared to be in

20  the public interest, and this law is an exercise of the police

21  power of the state for the protection of the public health,

22  safety, and welfare.  Such regulation must ensure that

23  monopoly services are subject to effective price, rate, and

24  service regulation. The provisions of this chapter shall be

25  liberally construed for the accomplishment of this purpose.

26         (4)  This chapter shall supersede all other laws on the

27  same subject, and subsequent inconsistent laws shall supersede

28  this chapter only to the extent that they do so by express

29  reference.  This chapter shall not impair or take away vested

30  rights other than procedural rights or benefits.

  1         Section 2.  This act shall take effect upon becoming a

  2  law.
