18 Section 1. Subsections (5) and (6) of section
19 112.061, Florida Statutes, are amended to read:
20 112.061 Per diem and travel expenses of public
21 officers, employees, and authorized persons.--
22 (5) COMPUTATION OF TRAVEL TIME FOR REIMBURSEMENT.--For
23 purposes of reimbursement and methods of calculating
24 fractional days of travel, the following principles are
25 prescribed:
26 (a) The travel day for Class A travel shall be a
27 calendar day (midnight to midnight). The travel day for Class
28 B travel shall begin at the same time as the travel period.
29 For Class A and Class B travel, the traveler shall be
30 reimbursed one-fourth of the authorized rate of per diem for
31 each quarter, or fraction thereof, of the travel day included

1 within the travel period. Class A and Class B travel shall
2 include any assignment on official business outside of regular
3 office hours and away from regular places of employment when
4 it is considered reasonable and necessary to stay overnight
5 and for which travel expenses are approved.
6 (b) A traveler shall not be reimbursed on a per diem
7 basis for Class C travel, but shall receive subsistence as
8 provided in this section, which allowance Allowances for meals
9 shall be based on the following schedule:
10 1. Breakfast--When travel begins before 6 a.m. and
11 extends beyond 8 a.m.
12 2. Lunch--When travel begins before 12 noon and
13 extends beyond 2 p.m.
14 3. Dinner--When travel begins before 6 p.m. and
15 extends beyond 8 p.m., or when travel occurs during nighttime
16 hours due to special assignment.

18 No allowance shall be made for meals when travel is confined
19 to the city or town of the official headquarters or immediate
20 vicinity; except assignments of official business outside the
21 traveler's regular place of employment if travel expenses are
22 approved. The Comptroller shall establish a schedule for
23 processing Class C travel subsistence payments at least on a
24 monthly basis.
25 (6) RATES OF PER DIEM AND SUBSISTENCE ALLOWANCE.--For
26 purposes of reimbursement rates and methods of calculation,
27 per diem and subsistence allowances are divided into the
28 following groups and rates:
29 (a) All travelers while on Class A or Class B travel
30 shall be allowed for subsistence when traveling to a
31 convention or conference or when traveling within or outside

1 the state in order to conduct bona fide state business, which
2 convention, conference, or business serves a direct and lawful
3 public purpose with relation to the public agency served by
4 the person attending such meeting or conducting such business,
5 either of the following for each day of such travel at the
6 option of the traveler:
7 1. Fifty dollars per diem; or
8 2. If actual expenses exceed $50, the amounts
9 permitted in paragraph (b) for meals, plus actual expenses for
10 lodging at a single-occupancy rate to be substantiated by paid
11 bills therefor.

13 When lodging or meals are provided at a state institution, the
14 traveler shall be reimbursed only for the actual expenses of
15 such lodging or meals, not to exceed the maximum provided for
16 in this subsection.
17 (b) All travelers shall be allowed the following
18 amounts for subsistence while on Class A or Class B Class C
19 travel on official business as provided in paragraph (5)(b):
20 1. Breakfast........................................$3
21 2. Lunch............................................$6
22 3. Dinner..........................................$12
23 (c) No one, whether traveling out of state or in
24 state, shall be reimbursed for any meal or lodging included in
25 a convention or conference registration fee paid by the state.
26 (d) For Class C travel, a traveler shall not be
27 reimbursed on a per diem basis nor shall the traveler receive
28 subsistence allowance.
29 Section 2. This act shall take effect July 1, 2001.
