2 An act relating to Class C travel; amending s.
3 112.061, F.S.; eliminating allowances for meals
4 for Class C travel; providing an effective
5 date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Subsections (5) and (6) of section 112.061,
10 Florida Statutes, are amended to read:
11 112.061 Per diem and travel expenses of public
12 officers, employees, and authorized persons.--
13 (5) COMPUTATION OF TRAVEL TIME FOR REIMBURSEMENT.--For
14 purposes of reimbursement and methods of calculating
15 fractional days of travel, the following principles are
16 prescribed:
17 (a) The travel day for Class A travel shall be a
18 calendar day (midnight to midnight). The travel day for Class
19 B travel shall begin at the same time as the travel period.
20 For Class A and Class B travel, the traveler shall be
21 reimbursed one-fourth of the authorized rate of per diem for
22 each quarter, or fraction thereof, of the travel day included
23 within the travel period. Class A and Class B travel shall
24 include any assignment on official business outside of regular
25 office hours and away from regular places of employment when
26 it is considered reasonable and necessary to stay overnight
27 and for which travel expenses are approved.
28 (b) A traveler shall not be reimbursed on a per diem
29 basis for Class C travel nor shall the traveler receive any
30 allowance for meals, but shall receive subsistence as provided

1 in this section, which allowance for meals shall be based on
2 the following schedule:
3 1. Breakfast--When travel begins before 6 a.m. and
4 extends beyond 8 a.m.
5 2. Lunch--When travel begins before 12 noon and
6 extends beyond 2 p.m.
7 3. Dinner--When travel begins before 6 p.m. and
8 extends beyond 8 p.m., or when travel occurs during nighttime
9 hours due to special assignment.

11 No allowance shall be made for meals when travel is confined
12 to the city or town of the official headquarters or immediate
13 vicinity; except assignments of official business outside the
14 traveler's regular place of employment if travel expenses are
15 approved. The Comptroller shall establish a schedule for
16 processing Class C travel subsistence payments at least on a
17 monthly basis.
18 (6) RATES OF PER DIEM AND SUBSISTENCE ALLOWANCE.--For
19 purposes of reimbursement rates and methods of calculation,
20 per diem and subsistence allowances are divided into the
21 following groups and rates:
22 (a) All travelers, except those undertaking Class C
23 travel, shall be allowed for subsistence when traveling to a
24 convention or conference or when traveling within or outside
25 the state in order to conduct bona fide state business, which
26 convention, conference, or business serves a direct and lawful
27 public purpose with relation to the public agency served by
28 the person attending such meeting or conducting such business,
29 either of the following for each day of such travel at the
30 option of the traveler:
31 1. Fifty dollars per diem; or

1 2. If actual expenses exceed $50, the amounts
2 permitted in paragraph (b) for meals, plus actual expenses for
3 lodging at a single-occupancy rate to be substantiated by paid
4 bills therefor.

6 When lodging or meals are provided at a state institution, the
7 traveler shall be reimbursed only for the actual expenses of
8 such lodging or meals, not to exceed the maximum provided for
9 in this subsection.
10 (b) The amounts allowed for subsistence shall be as
11 follows All travelers shall be allowed the following amounts
12 for subsistence while on Class C travel on official business
13 as provided in paragraph (5)(b):
14 1. Breakfast........................................$3
15 2. Lunch............................................$6
16 3. Dinner..........................................$12
17 (c) No one, whether traveling out of state or in
18 state, shall be reimbursed for any meal or lodging included in
19 a convention or conference registration fee paid by the state.
20 Section 2. This act shall take effect July 1, 2001.
