1 A bill to be entitled
2 An act relating to public records; amending s.
3 119.07, F.S.; specifying the financial
4 statements submitted to a state agency by
5 prospective bidders which are confidential and
6 exempt from the public records law; providing a
7 statement of public necessity; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Paragraph (t) of subsection (3) of section
13 119.07, Florida Statutes, is amended to read:
14 119.07 Inspection, examination, and duplication of
15 records; exemptions.--
16 (3)
17 (t) Any financial statement, including specifically
18 any profit-and-loss statement, payroll record, record of
19 fringe benefits, or cost statement of administrative overhead,
20 which an agency requires a prospective bidder to submit in
21 order to prequalify for bidding or for responding to a
22 proposal for a road or any other public works project is
23 exempt from the provisions of subsection (1) and s. 24(a),
24 Art. I of the State Constitution.
25 Section 2. The Legislature finds that the
26 clarification of a financial statement provided by this act is
27 necessary to effectively and efficiently administer the
28 contracting process for state agencies. The Legislature
29 further finds that without the specific clarification provided
30 in this act, prospective bidders would be unsure as to the
31 information that is confidential, thus eroding the ability of

1 state agencies to collect the proper sensitive information
2 that is necessary in order to obtain contracts at the best
3 price.
4 Section 3. This act shall take effect upon becoming a
5 law.

9 Provides that certain specified financial statements
submitted to a state agency by a prospective bidder are
10 confidential and exempt from the public records law.
