  2         An act relating to school board service

  3         programs; creating the "David Levitt School

  4         Food Anti-Hunger Act of 2001"; amending s.

  5         228.195, F.S.; requiring school districts to

  6         donate surplus or excess canned or perishable

  7         foods to food recovery or hunger assistance

  8         programs; providing exemptions; authorizing

  9         rules; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Short title.--This act may be cited as the

14  "David Levitt School Food Anti-Hunger Act of 2001."

15         Section 2.  Subsection (6) is added to section 228.195,

16  Florida Statutes, to read:

17         228.195  School food service programs.--

18         (6)  DISPOSITION OF UNUSED FOOD.--

19         (a)  School districts shall donate on a regular basis,

20  in accordance with health, safety, and sanitation guidelines,

21  any surplus or excess canned or perishable foods that would

22  otherwise be discarded to food recovery programs, pursuant to

23  s. 570.0725, or to hunger assistance programs provided through

24  community charities or not-for-profit corporations, including

25  faith-based organizations, which provide for the hungry.

26         (b)  Such donations shall be made pursuant to s.

27  768.136.

28         (c)  School districts in communities with no food

29  recovery or hunger assistance programs are exempt from this

30  subsection.

  1         (d)  The State Board of Education shall have the

  2  authority to adopt rules pursuant to ss. 120.536(1) and 120.54

  3  to implement the provisions of this subsection.

  4         Section 3.  This act shall take effect upon becoming a

  5  law.
