1 A bill to be entitled
2 An act relating to Polk County; requiring the
3 Southwest Florida Water Management District to
4 relinquish their ownership, control, and
5 operation of the four water control structures
6 known as P-5, P-6, P-7, P-8 and their
7 associated roadways, easements, and canals to
8 the Lake Region Lakes Management District;
9 providing a set of conditions; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. The Southwest Florida Water Management
15 District shall relinquish ownership, control, and operation of
16 four water control structures and their associated roadways,
17 easements, and canals to the Lake Region Lakes Management
18 District. These facilities are located in Polk County on what
19 is known as the north chain of lakes. The structures are
20 identified as P-5, P-6, P-7, and P-8. This transfer will be
21 done under the following terms:
22 (1) The Lake Region Lakes Management District agrees
23 to operate and maintain these structures and associated
24 facilities. Operation of these structures will be done based
25 on lake levels lawfully established by the Southwest Florida
26 Water Management District;
27 (2) The Southwest Florida Water Management District
28 will continue to own, operate and maintain the water level
29 reading equipment that is currently on site and it will
30 provide the Lake Region Lakes Management District with direct
31 access to this system;

1 (3) The Southwest Florida Water Management District
2 will have these structures inspected and correct any major
3 problems. These repairs must be completed within 5 years after
4 this act takes effect; and
5 (4) The Southwest Florida Water Management District
6 will provide the Lake Region Lakes Management District with
7 funds on a yearly basis for a period of 5 years. These funds
8 will be equal to an average of what the Southwest Florida
9 Water Management District has spent over the last 5 years to
10 maintain the structures and is to be adjusted by adding in the
11 cost of the repairs required by the inspection. These costs
12 will include, but not be limited to, the cost of mowing,
13 sodding, spraying, fence work, painting, inspections, road
14 work, digging, excavating, providing riprap, greasing, parts
15 replacements, providing all equipment used for repairs
16 including airboats and trucks, and all contract work.
17 Section 2. This act shall take effect October 1, 2001.
