5 Intellectual Capital, Product Design, and
6 Commercialization; providing for membership;
7 providing purposes; requiring the commission to
8 develop a plan; requiring an annual report to
9 the Legislature; providing commission goals;
10 providing for an executive director and staff;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Section 288.9521, Florida Statutes, is
16 created to read:
17 288.9521 Sunshine State Commission on Intellectual
18 Capital, Product Design, and Commercialization.--
19 (1) The Sunshine State Commission on Intellectual
20 Capital, Product Design, and Commercialization is created
21 within the Executive Office of the Governor. Members of the
22 commission shall consist of the Governor, the chair of the
23 Florida Board of Education or his or her designee, the chair
24 of the Education K-20 Policy and Research Commission, the
25 presidents of the public and private research universities in
26 this state or their appointees, and the chairs of Enterprise
27 Florida, Inc., and Workforce Florida, Inc. In addition, the
28 Governor shall appoint seven chief executive officers of
29 existing companies or heads of former companies known for new
30 initiatives and three heads of existing venture capital
31 companies to the commission. All commission members shall be

1 appointed no later than November 1, 2001. The commission may
2 create and dissolve advisory committees, working groups, and
3 task forces as necessary to carry out the duties and
4 responsibilities of the commission. Such advisory committees,
5 working groups, and task forces may consist of commission
6 members and other persons with knowledge and expertise related
7 to the committee, group, or task force created. The
8 commission shall meet at least triannually.
9 (2) The purposes of the commission shall be to foster
10 and facilitate technology-based research and the enhancement
11 of intellectual capital, the promotion of product development
12 and commercialization, and the creation of new companies and
13 expansion of existing companies located within this state to
14 the fullest extent possible. The commission shall also
15 develop a plan which shall include recommendations to address
16 the following and all related issues:
17 (a) Targeting industrial development in areas of
18 particular promise for Florida.
19 (b) Facilitating the collaboration between state
20 universities, state agencies, and the private sector for
21 conducting research and accelerating the transfer and
22 commercialization of technology and intellectual products into
23 the private sector, including determining the extent to which
24 provisions in s. 112.313 create barriers to technology
25 transfer.
26 (c) Recommending to the Legislature and the Florida
27 Board of Education any funding and initiatives to enhance
28 university-based or university-affiliated scientific and
29 technical research in areas with potential to create
30 top-tiered employment in Florida's economy, recruit
31 outstanding university research faculty who have demonstrated

1 an expertise and an excellence in research, and develop
2 world-class research facilities.
3 (d) Promoting collaboration among multiple
4 universities on research projects so that the synergies of
5 Florida's research universities can support the development
6 and achievement of the industrial and economic goals of the
7 state.
8 (e) Ensuring that appropriate business, financial, and
9 technical assistance is available in the early, high-risk
10 stages of development.
11 (f) Identifying opportunities and mobilizing state
12 efforts to establish government and private sector supported
13 research labs.
14 (g) Identifying and reporting to the Office of
15 Workforce and Economic Development of the Commissioner of
16 Education specific academic and vocational training programs
17 that produce the skilled workforce necessary for targeted
18 industries.
19 (h) Building strong and long-term partnerships among
20 worldwide industries, Florida's universities, and vocational
21 training programs so that all are strengthened.
22 (i) Developing incentive mechanisms and performance
23 measures for the activities by universities, vocational
24 training programs, and other government programs that support
25 technology-based industry.
26 (j) Building an entrepreneurial culture in Florida's
27 universities and state agencies that supports and nurtures
28 technology transfer and the formation of new products and
29 companies.
30 (k) Coordinating commission efforts with Enterprise
31 Florida, Inc., Workforce Florida, Inc., the Agency for

1 Workforce Innovation, the Florida Board of Education, the
2 Education K-20 Policy and Research Commission, and the state's
3 postsecondary educational institutions.
4 (3) The commission shall provide to the President of
5 the Senate and the Speaker of the House of Representatives, no
6 later than December 31, 2002, and each year thereafter, an
7 annual report of the activities and accomplishments of the
8 commission and participating businesses and institutions. The
9 report shall include: the plan required pursuant to subsection
10 (2); a description of activities such as the patenting and
11 licensing of intellectual property by participating
12 universities, state agencies, and businesses; the production
13 of graduates from programs as a result of targeted efforts;
14 and the activities of business-education collaborations. The
15 report shall describe and evaluate the impact of commission
16 and legislative initiatives to promote the development of new
17 technology in this state and recommend new or amended
18 initiatives. The report shall also describe and evaluate
19 existing programs that support small businesses and determine
20 if new programs are needed or if existing programs should be
21 improved, consolidated, or organized differently.
22 (4) An initial effort of the commission shall be to
23 evaluate alternative approaches needed to facilitate
24 technology transfer. The commission shall examine existing
25 initiatives in this state, other states, and other countries
26 that include collaboration among multiple universities,
27 policies and initiatives for promoting collaboration and
28 resolving disputes over intellectual property rights, and
29 other related issues. Finally, the commission shall develop a
30 set of criteria for targeting and funding enhancements to
31 universities and vocational programs.

1 (5) An executive director of the commission shall be
2 appointed by and serve at the pleasure of the commission. The
3 executive director shall employ persons sufficient to staff
4 the commission as deemed necessary and appropriate to carry
5 out the commission's responsibilities and functions.
6 Section 2. This act shall take effect upon becoming a
7 law.
