  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Department of Revenue Clerks of the Court Trust

  4         Fund; providing for sources of funds and

  5         purposes; providing for future review and

  6         termination or re-creation of the trust fund;

  7         providing a contingent effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  (1)  The Department of Revenue Clerks of

12  the Court Trust Fund is created within the Department of

13  Revenue. Funds received by the department from the clerks of

14  court shall be credited to the trust fund as provided in

15  Senate Bill _____, or similar legislation, to be used for the

16  purposes set forth in such legislation.

17         (2)  In accordance with Section 19(f)(2), Article III

18  of the State Constitution, the trust fund must, unless

19  terminated sooner, be terminated on July 1, 2005. Before its

20  scheduled termination, the trust fund must be reviewed as

21  provided in section 215.3206(1) and (2), Florida Statutes.

22         Section 2.  This act shall take effect on the effective

23  date of Senate Bill _____, or similar legislation, but it

24  shall not take effect unless it is enacted by a three-fifths

25  vote of the membership of each house of the Legislature and

26  unless SB _____, 2001 Regular Session, becomes a law.
