  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Department of Revenue Clerks of the Court Trust

  4         Fund; providing for sources of funds and

  5         purposes; providing for future review and

  6         termination or re-creation of the trust fund;

  7         providing a contingent effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  (1)  The Department of Revenue Clerks of

12  the Court Trust Fund is created within the Department of

13  Revenue. Funds received by the department from the clerks of

14  court shall be credited to the trust fund as provided in

15  Committee Substitute for Senate Bill 1852, or similar

16  legislation, to be used for the purposes set forth in such

17  legislation.

18         (2)  In accordance with Section 19(f)(2), Article III

19  of the State Constitution, the trust fund must, unless

20  terminated sooner, be terminated on July 1, 2005. Before its

21  scheduled termination, the trust fund must be reviewed as

22  provided in section 215.3206(1) and (2), Florida Statutes.

23         Section 2.  This act shall take effect on the effective

24  date of Committee Substitute for Senate Bill 1852, or similar

25  legislation, but it shall not take effect unless it is enacted

26  by a three-fifths vote of the membership of each house of the

27  Legislature and unless Committee Substitute for Senate Bill

28  1852, or similar legislation, becomes a law.
