  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Services Trust Fund within the Department of

  4         Management Services; providing sources of

  5         funds; specifying uses of funds; providing for

  6         future review and termination or re-creation of

  7         the trust fund; providing for disposition of

  8         balances in the trust fund if the fund is not

  9         re-created; prescribing procedures for

10         terminating the trust fund; providing a

11         contingent effective date.

13  Be It Enacted by the Legislature of the State of Florida:

15         Section 1.  (1)  The Services Trust Fund is created

16  within the Department of Management Services. Funds shall be

17  credited to the trust fund as provided by law and pursuant to

18  legislative appropriations. The trust fund shall be used for

19  the purposes set forth by law.

20         (2)  In accordance with Section 19(f)(2) of Article III

21  of the State Constitution, the Services Trust Fund shall,

22  unless terminated sooner, be terminated on July 1, 2005.

23  Before its scheduled termination, the trust fund shall be

24  reviewed as provided in sections 215.3206(1) and (2), Florida

25  Statutes.

26         (3)  If the trust fund is terminated and not

27  immediately re-created, all cash balances and income of the

28  trust fund shall be deposited into the General Revenue Fund.

29  The Department of Management Services shall pay any

30  outstanding debts or obligations of the trust fund as soon as

31  practicable, and the Comptroller shall close out and remove

  1  the trust fund from the various state accounting systems,

  2  using generally accepted accounting practices concerning

  3  warrants outstanding, assets, and liabilities.

  4         Section 2.  This act shall take effect July 1, 2001, if

  5  SB ____ or similar legislation is adopted in the same

  6  legislative session, or an extension thereof, and becomes law.
