2 An act relating to subsidized child care;
3 amending s. 402.3015, F.S.; requiring the
4 Social Services Estimating Conference to
5 determine utilization rates for child care
6 funding categories; requiring that surplus
7 child care funds be used to provide child care
8 for income eligible families; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (10) of section 402.3015,
14 Florida Statutes, is amended to read:
15 402.3015 Subsidized child care program; purpose; fees;
16 contracts.--
17 (10) A family that is eligible to participate in the
18 subsidized child care program shall be considered a needy
19 family for purposes of the program funded through the federal
20 Temporary Assistance for Needy Families (TANF) block grant, to
21 the extent permitted by the appropriation of funds. The Social
22 Services Estimating Conference shall determine and agree to by
23 May 31 of each year the projected utilization rates for the
24 temporary cash assistance and welfare transition child care
25 funding category and the working poor child care funding
26 category. Notwithstanding the provisions of chapter 216, if a
27 surplus is projected in the temporary cash assistance and
28 welfare transition child care funding category and there is a
29 determined need in the working poor child care funding
30 category, the surplus funds shall be used to provide subsidies

1 for families who are income eligible and served in the working
2 poor child care funding category.
3 Section 2. This act shall take effect upon becoming a
4 law.

Requires the Social Services Estimating Conference to
10 determine and agree to the utilization rates for the temporary
cash assistance and welfare transition child care funding
11 category and the working poor child care funding category by
May 31 of each year.

Provides for the use of surplus funds in the temporary cash
13 assistance and welfare transition funding category for income
eligible families in the working poor category without
14 adherence to the budget amendment process of ch. 216, F.S.
15 Provides for the bill to become effective upon becoming law,
rather than July 1, 2001.
