  1                      A bill to be entitled

  2         An act relating to malt beverages; amending s.

  3         563.06, F.S.; removing current restrictions on

  4         containers under a specified size, subject to

  5         certain conditions; imposing requirements on

  6         malt beverages imported from foreign countries;

  7         providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (6) of section 563.06, Florida

12  Statutes, is amended to read:

13         563.06  Malt beverages; imprint on individual

14  container; size of containers; exemptions.--

15         (6)  All malt beverages packaged in individual

16  containers sold or offered for sale by vendors at retail in

17  this state shall be in individual containers containing not

18  more than only 8, 12, 16, or 32 ounces of such malt beverages;

19  provided, however, that nothing contained in this section

20  shall affect malt beverages packaged in bulk or in kegs or in

21  barrels or in any individual container containing 1 gallon or

22  more of such malt beverage regardless of individual container

23  type. No individual container containing more than 16 ounces

24  of malt beverages shall contain more then 3.2 percent alcohol

25  by volume. Malt beverages manufactured or packaged in a

26  foreign country may be sold in this state only after the

27  department has been provided with a written certification, in

28  a form prescribed by the department, that affirms that malt

29  beverages manufactured or packaged in this state in American

30  standards of measurements may be sold in that foreign country.

  1         Section 2.  This act shall take effect upon becoming a

  2  law.

  5                          HOUSE SUMMARY

  6
      Provides that all malt beverages packaged in individual
  7    containers shall be sold in containers of not more than
      32 ounces. Provides that no individual container
  8    containing more than 16 ounces of malt beverages shall
      contain more than 3.2 percent alcohol by volume. Provides
  9    requirements with respect to malt beverages manufactured
      or packaged in a foreign country. See bill for details.
