  1                      A bill to be entitled

  2         An act relating to the district school tax;

  3         amending s. 236.25, F.S.; allowing certain

  4         school districts to levy, by referendum,

  5         additional district school taxes; providing

  6         limitations on the uses of the resulting

  7         revenues; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (6) is added to section 236.25,

12  Florida Statutes, to read:

13         236.25  District school tax.--

14         (6)  In addition to the maximum millage levied under

15  this section and the General Appropriations Act, a school

16  district that is operating under a Seal of Best Financial

17  Management issued under s. 230.23025 may levy, by local

18  referendum, additional millage for school operational purposes

19  up to an amount that, when combined with nonvoted millage

20  levied under this section, does not exceed the 10-mill limit

21  established in s. 9(b), Art. VII of the State Constitution.

22  Any such levy shall be for a maximum of 4 years and shall be

23  counted as part of the 10-mill limit established in s. 9(b),

24  Art. VII of the State Constitution. Millage elections

25  conducted under the authority granted pursuant to this section

26  are subject to ss. 236.31 and 236.32. Funds generated by such

27  additional millage do not become a part of the calculation of

28  the Florida Education Finance Program total potential funds in

29  2001-2002 or any subsequent year and must not be incorporated

30  in the calculation of any hold-harmless or other component of

31  the Florida Education Finance Program formula in any year.

  1         Section 2.  This act shall take effect July 1, 2001.

  5    Allows a school district that is operating under a Seal
      of Best Financial Management to levy, by local
  6    referendum, additional district school taxes, for a
      maximum period of 4 years. Provides limitations on the
  7    uses of such tax revenues.
