  1                      A bill to be entitled
  2         An act relating to postsecondary education;
  3         authorizing the Board of Regents and the State
  4         Board of Community Colleges, in implementing a
  5         single, statewide computer-assisted student
  6         advising system, to secure and enforce patents
  7         on work products, enter into various
  8         agreements, and sell work products; providing
  9         for any or all of the proceeds derived from
10         such activities to be used to develop and
11         maintain the computer-assisted student advising
12         system; providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

16         Section 1.  (1)  In implementing the single, statewide
17  computer-assisted student advising system required under
18  section 240.2099, Florida Statutes, the Board of Regents and
19  the State Board of Community Colleges may:
20         (a)  Perform all things necessary to secure letters of
21  patent, copyrights, and trademarks on any work products and
22  enforce their rights with respect thereto.
23         (b)  Enter into binding agreements with organizations,
24  corporations, or government entities to license, lease,
25  assign, or otherwise give written consent to any person, firm,
26  corporation, or agency for the use of the single, statewide,
27  computer-assisted student advising system and collect
28  royalties or any other consideration that the boards find
29  proper.
30         (c)  Sell any such work products and execute all
31  instruments necessary to consummate the sale.

  1         (2)  All or a portion of the proceeds derived from
  2  activities authorized under this section may be expended for
  3  the costs incurred in developing and maintaining the single,
  4  statewide computer-assisted student advising system.
  5         Section 2.  This act shall take effect upon becoming a
  6  law.

  9                          SENATE SUMMARY
10    Authorizes the Board of Regents and the State Board of
      Community Colleges to secure and enforce patents, enter
11    into various license and lease agreements, and sell work
      products as part of the duties of the boards in
12    developing and implementing a single, statewide
      computer-assisted student advising system. Provides for
13    the use of proceeds derived from such activities.
