1 A bill to be entitled
2 An act relating to postsecondary education;
3 authorizing the Board of Regents and the State
4 Board of Community Colleges, in implementing a
5 single, statewide computer-assisted student
6 advising system, to secure and enforce patents
7 on work products, enter into various
8 agreements, and sell work products; providing
9 for any or all of the proceeds derived from
10 such activities to be used to develop and
11 maintain the computer-assisted student advising
12 system; requiring review and comment by
13 legislative leaders; providing an effective
14 date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. (1) In implementing the single, statewide
19 computer-assisted student advising system required under
20 section 240.2099, Florida Statutes, the Board of Regents and
21 the State Board of Community Colleges may:
22 (a) Perform all things necessary to secure letters of
23 patent, copyrights, and trademarks on any work products and
24 enforce their rights with respect thereto.
25 (b) Enter into binding agreements with organizations,
26 corporations, or government entities to license, lease,
27 assign, or otherwise give written consent to any person, firm,
28 corporation, or agency for the use of the single, statewide,
29 computer-assisted student advising system and collect
30 royalties or any other consideration that the boards find
31 proper.

1 (c) Sell or license any such work products and execute
2 all instruments necessary to consummate the sale or license.
3 (d) The Board of Regents and the State Board of
4 Community Colleges shall submit to the President of the Senate
5 and the Speaker of the House of Representatives any agreement
6 relating to this act. The President and Speaker may review the
7 terms of the agreement and respond with comments for 30 days
8 after receipt of an agreement; after that time, the agreement
9 is binding.
10 (2) All or a portion of the proceeds derived from
11 activities authorized under this section may be expended for
12 the costs incurred in developing and maintaining the single,
13 statewide computer-assisted student advising system.
14 Section 2. This act shall take effect upon becoming a
15 law.

20 The Committee Substitute authorizes the boards to license the
products, and it delays any agreement by 30 days for review by
21 Legislative leaders.
