14 On page 63, between lines 23 and 24 of the bill
15
16 insert:
17 (3) The agency shall every 15 months conduct at least
18 one unannounced inspection to determine compliance by the
19 licensee with statutes, and with rules promulgated under the
20 provisions of those statutes, governing minimum standards of
21 construction, quality and adequacy of care, and rights of
22 residents. This survey shall be conducted every 6 months, for
23 the next two year period, if the facility has been cited for a
24 Class I deficiency, or two or more Class II deficiencies
25 arising from separate surveys or investigations within a 60
26 day period, or has had three or more substantiated complaints
27 within a six month period, each resulting in at least one
28 Class I or II deficiency. In addition to any other fees or
29 fines in this part, the agency shall assess a survey fee for
30 each facility that is subject to the 6-month survey cycle. The
31 additional survey fee for the two-year period shall be $6,000,

1 one-half to be paid at the completion of each survey. The
2 agency may adjust this fee by the consumer price index based
3 on the 12 months immediately preceding the increase to cover
4 the cost of the additional surveys. The agency shall verify
5 through subsequent inspection that any deficiency identified
6 during the annual inspection is corrected. However, the
7 agency may verify the correction of a class III or class IV
8 deficiency unrelated to resident rights or resident care
9 without reinspecting the facility if adequate written
10 documentation has been received from the facility as required,
11 which provides assurance that the deficiency has been
12 corrected. The giving or causing to be given of advance
13 notice of such unannounced inspections by an employee of the
14 agency to any unauthorized person shall constitute cause for
15 suspension of not fewer than 5 working days according to the
16 provisions of chapter 110.
17 (4) The agency shall conduct unannounced onsite
18 facility reviews following written verification of licensee
19 noncompliance in instances in which a long-term care ombudsman
20 council, pursuant to ss. 400.0071 and 400.0075, has received a
21 complaint and has documented deficiencies in resident care or
22 in the physical plant of the facility that threaten the
23 health, safety, or security of residents, or when the agency
24 documents through inspection that conditions in a facility
25 present a direct or indirect threat to the health, safety, or
26 security of residents. However, the agency shall conduct four
27 or more unannounced onsite reviews every 3 months within a
28 12-month period of each facility while the facility which has
29 a conditional license licensure status. Deficiencies related
30 to physical plant do not require followup reviews after the
31 agency has determined that correction of the deficiency has

1 been accomplished and that the correction is of the nature
2 that continued compliance can be reasonably expected.
