  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         20.505, F.S.; creating the Administrative Trust

  4         Fund within the Agency for Workforce

  5         Innovation; providing for sources of funds and

  6         purposes; providing for annual carryforward of

  7         funds; providing for future review and

  8         termination or re-creation of the trust fund;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Section 20.505, Florida Statutes, is

14  created to read:

15         20.505  Administrative Trust Fund of the Agency for

16  Workforce Innovation.--

17         (1)  The Administrative Trust Fund is created within

18  the Agency for Workforce Innovation.

19         (2)  Funds to be credited to the trust fund shall

20  consist of indirect cost assessments against the operating

21  entities of the agency. Funds shall be used for the purpose of

22  supporting the administrative functions of the agency as

23  required by law, pursuant to legislative appropriation or an

24  approved amendment to the agency's operating budget pursuant

25  to the provisions of chapter 216.

26         (3)  Notwithstanding the provisions of s. 216.301 and

27  pursuant to s. 216.351, any balance in the trust fund at the

28  end of any fiscal year shall remain in the trust fund at the

29  end of the year and shall be available for carrying out the

30  purposes of the trust fund.

  1         (4)  Pursuant to the provisions of s. 19(f)(2), Art.

  2  III of the State Constitution, the trust fund shall, unless

  3  terminated sooner, be terminated on July 1, 2005. Prior to its

  4  scheduled termination, the trust fund shall be reviewed as

  5  provided in s. 215.3206(1) and (2).

  6         Section 2.  This act shall take effect July 1, 2001.
