1 A bill to be entitled
2 An act relating to the State Technology Office;
3 providing intent; requiring a study and report
4 to the Legislature regarding the collection and
5 storage of certain information; providing an
6 effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. (1) The Legislature finds that
11 technological advances have made it possible for state and
12 local governments to operate more efficiently and
13 economically. Increased use of computers by governments,
14 businesses, and individuals, the growth of the Internet, and
15 the likelihood of further technological advances will permit
16 even more coordination of services, greater sharing of
17 information, and additional opportunities to improve services.
18 The Legislature also recognizes that this state has a long
19 policy of open records that is ensured by the State
20 Constitution. The Legislature also recognizes that the
21 constitutional right of privacy provided under the State
22 Constitution cannot be construed to limit the public's right
23 of access to public records. As a result, the Legislature
24 finds that more consideration should be given to the types of
25 information that are collected, the purpose of collecting each
26 type of information, and whether it is necessary to collect
27 all the information that is currently being amassed by state
28 and local governmental entities.
29 (2) The State Technology Office shall conduct a survey
30 of executive state agencies, the State University System,
31 clerks of court, and local governmental entities regarding the

1 types of information they compile in databases or other
2 electronic formats, sell or share with third parties, and
3 provide online and shall make recommendations and submit a
4 written report to the Legislature by February 1, 2002.
5 Section 2. This act shall take effect upon becoming a
6 law.

10 Requires the State Technology Office to conduct a study

by state agencies, the State University System, clerks of
12 court, and local government entities.
