  1                      A bill to be entitled

  2         An act relating to Escambia County; amending

  3         chapter 83-405, Laws of Florida, as amended,

  4         relating to the Escambia County Civil Service

  5         System; providing for the discretionary

  6         withdrawal of certain constitutional officers

  7         and the District School Board from the Civil

  8         Service system; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection 7.1 of section 7 of chapter

13  83-405, Laws of Florida, as amended by chapter 91-335, Laws of

14  Florida, is amended to read:

15         SECTION 7.  APPLICABILITY.

16         7.1  Covered Positions and Exemptions.  The career

17  Civil Service system established by this Act may shall be a

18  permanent service and shall apply as determined by a county

19  constitutional officer or a majority vote of a local agency or

20  board to and include all employees serving in positions now

21  existing, or hereafter created, in Escambia County, including

22  employees of the Escambia County Utilities Authority and

23  non-instructional employees or positions of the District

24  School Board., except the following who shall be exempt from

25  the career Civil Service:

26         (a)  Elected officials or persons appointed by the

27  Governor.

28         (b)  Members of county and local boards and county

29  commissions.

30         (c)  Members of advisory councils or committees or

31  similar boards paid only for attendance at meetings.

  1         (d)  The County Attorney and any Assistant Attorneys,

  2  or secretaries employed by or under him or her.

  3         (e)  Attorneys serving as legal counsel.

  4         (f)  Persons of highly technical or professional

  5  training maintaining an independent practice in their chosen

  6  professions and employed by the county on a part-time basis.

  7         (g)  Patient or inmate help in charitable, penal and

  8  correctional institutions.

  9         (h)  District School Board:

10         The chief executive officer and all department heads as

11  approved by the District School Board.

12         Instructional personnel as defined in Section

13  228.041(9), Florida Statutes.

14         Administrative personnel as defined in Section

15  228.041(10), Florida Statutes.

16         Secretary to Superintendent of Schools.

17         Secretary to District School Board.

18         Secretary to Administrative Assistant to Superintendent

19  of Schools.

20         Director of Automated Office Systems.

21         Director of Public Information.

22         Assistant Director for School Plant Planning.

23         Auditors.

24         (i)  Board of County Commissioners:

25         The chief executive officer and all department heads as

26  approved by the Board of County Commissioners.

27         (j)  Property Appraiser's Office:

28         Chief Deputy Property Appraiser.

29         Secretary to the Property Appraiser.

30         Three Deputy Appraisers to the Property Appraiser.

  3         (p)  Manager of Santa Rosa Island Authority.

  4         (q)  One secretary to each Judge of Circuit and County

  5  Courts.

  6         (r)  The employees of Century Memorial Hospital.

  7         (s)  Student assistants as defined by Civil Service

  8  Rule provided, however, that the appointing authorities shall

  9  report the identity of any students and their general duties

10  to the Civil Service Board.

11         Section 2.  Section 7.2 of section 7 of chapter 83-405,

12  Laws of Florida, as amended by chapter 91-335, Laws of

13  Florida, is amended to read:

14         7.2  Option to Withdraw from Civil Service. Upon the

15  effective date of this act, the Supervisor of Elections, the

16  Tax Collector, the Property Appraiser, the Clerk of the Court,

17  and the District School Board may elect by a majority vote of

18  the governing body, or for the four county constitutional

19  officers specified herein, by written notice to the Civil

20  Service Board, to withdraw from the Civil Service system, in

21  which case the local board or county constitutional officer

22  shall be exempt from the provisions of chapter 83-405, Laws of

23  Florida, as amended in all its parts. Additional Positions

24  Eligible for Exemption.  In addition to those positions

25  described in paragraphs (a) through (s) in subsection 7.1, the

26  following positions may, by rule of the Board, also be exempt

27  from the career Civil Service:

28         (a)  Registered nurses and medical doctors.

29         (b)  The executive head and a deputy or deputies to the

30  executive head and other positions of each county agency as

31  warranted by the size and complexity of the organization,

  1  scope of programs and nature of the positions.  Where more

  2  than one deputy is required in an exempt position by an

  3  agency, justification must be submitted to and be approved by

  4  the Board.

  5         (c)  Confidential assistant or secretary to an exempt

  6  official.

  7         (d)  Employees of the Escambia County Public Health

  8  Trust organized and existing pursuant to Chapter 154, Florida

  9  Statutes.

10         Section 3.  This act shall take effect upon becoming a

11  law.
