17 Section 46. Section 570.085, Florida Statutes, is
18 created to read:
19 570.085 Department of Agriculture and Consumer
20 Services; agricultural water conservation.--The department
21 shall establish an agricultural water conservation program
22 that includes the following:
23 (1) A cost share program, coordinated where
24 appropriate with the United States Department of Agriculture
25 and other federal, state, regional, and local agencies, for
26 irrigation system retrofit and application of mobile
27 irrigation laboratory evaluations for water conservation as
28 provided in this section and, where applicable, for water
29 quality improvement pursuant to s. 403.067(7)(d).
30 (2) The development and implementation of voluntary
31 interim measures or best management practices, adopted by

1 rule, which provide for increased efficiencies in the use and
2 management of water for agricultural production. In the
3 process of developing and adopting rules for interim measures
4 or best management practices, the department shall consult
5 with the Department of Environmental Protection and the water
6 management districts. Such rules may also include a system to
7 assure the implementation of the practices, including
8 recordkeeping requirements. As new information regarding
9 efficient agricultural water use and management becomes
10 available, the department shall reevaluate and revise as
11 needed, the interim measures or best management practices.
12 The interim measures or best management practices may include
13 irrigation retrofit, implementation of mobile irrigation
14 laboratory evaluations and recommendations, water resource
15 augmentation, and integrated water management systems for
16 drought management and flood control and should, to the
17 maximum extent practicable, be designed to qualify for
18 regulatory incentives and other incentives, as determined by
19 the agency having applicable statutory authority.
20 (3) Provision of assistance to the water management
21 districts in the development and implementation of a
22 consistent, to the extent practicable, methodology for the
23 efficient allocation of water for agricultural irrigation.
