18 (7)(a) The board shall prescribe by rule continuing
19 education requirements intended to ensure protection of the
20 public through updated training of licensees and registered
21 specialists, not to exceed 16 hours biennially, as a condition
22 for renewal of a license or registration as a specialist under
23 this chapter. Continuing education courses shall include, but
24 not be limited to, the following subjects as they relate to
25 the practice of cosmetology: human immunodeficiency virus and
26 acquired immune deficiency syndrome; Occupational Safety and
27 Health Administration regulations; workers' compensation
28 issues; state and federal laws and rules as they pertain to
29 cosmetologists, cosmetology, salons, specialists, specialty
30 salons, and booth renters; chemical makeup as it pertains to
31 hair, skin, and nails; and environmental issues. Courses given

1 at cosmetology conferences may be counted toward the number of
2 continuing education hours required if approved by the board.
3 (b) Any person whose occupation or practice is
4 confined solely to hair braiding, hair wrapping, or body
5 wrapping is exempt from the continuing education requirements
6 of this subsection.
7 (c) The board shall by rule establish criteria for the
8 approval of continuing education courses and providers. The
9 board may, by rule, require any licensee in violation of a
10 continuing education requirement to take a refresher course or
11 refresher course and examination in addition to any other
12 penalty. The number of hours for the refresher course may not
13 exceed 48 hours.
14 (d) The department shall approve all continuing
15 education courses and providers as set forth in this
16 subsection. The department may not approve any course which
17 does not substantially and exclusively relate to the practice
18 of cosmetology and serve to ensure the protection of the
19 public. Courses given at cosmetology conferences may be
20 counted toward the number of continuing education hours
21 required if approved by the department.
22 (e) Correspondence courses may be approved if offered
23 by a provider approved by the department under paragraph (d)
24 and meet all relevant course criteria established by the
25 board. Correspondence courses must include a written post
26 course examination developed and graded by the course provider
27 which demonstrates the licensee's understanding of the subject
28 matter taught by the course. The board may, by rule, set the
29 minimum allowed passing score for such examinations.
