22         98.255  Voter-education programs.--
23         (1)  By March 1, 2002, the Department of State shall
24  adopt rules prescribing minimum standards for nonpartisan
25  voter education. In developing the rules, the department shall
26  review current voter-education programs within each county of
27  the state. The standards shall address, but are not limited
28  to, the following subjects:
29         (a)  Voter registration;
30         (b)  Balloting procedures, absentee and polling place; 
31         (c)  Voter rights and responsibilities;

HOUSE AMENDMENT Bill No. CS/HB 1925 Amendment No. ___ (for drafter's use only) 1 (d) Distribution of sample ballots; and 2 (e) Public service announcements. 3 (2) Each supervisor of elections shall implement the 4 minimum voter-education standards and shall conduct additional 5 nonpartisan education efforts as necessary to ensure that 6 voters have a working knowledge of the voting process. 7 (3)(a) By December 15 of each general election year, 8 each supervisor of elections shall report to the Department of 9 State a detailed description of the voter-education programs 10 implemented and any other information that may be useful in 11 evaluating the effectiveness of voter-education efforts. 12 (b) The Department of State, upon receipt of such 13 information, shall prepare a public report on the 14 effectiveness of voter-education programs and shall submit the 15 report to the Governor, the President of the Senate, and the 16 Speaker of the House of Representatives by January 31 of each 17 year following a general election. 18 (c) The Department of State shall reexamine the rules 19 adopted pursuant to subsection (1) and consider the findings 20 in the report as a basis for adopting modified rules that 21 incorporate successful voter-education programs and 22 techniques, as necessary. 23 Section 52. Section 102.014, Florida Statutes, is 24 created to read: 25 102.014 Pollworker recruitment and training.-- 26 (1) The supervisor of elections shall conduct training 27 for inspectors, clerks, and deputy sheriffs prior to each 28 primary, general, and special election for the purpose of 29 instructing such persons in their duties and responsibilities 30 as election officials. No person shall serve as an inspector, clerk, or 2 deputy sheriff for an election unless such person has 3 completed the training as required. A clerk may not work at 4 the polls unless he or she demonstrates a working knowledge of 5 the laws and procedures relating to voter registration, voting 6 system operation, balloting and polling place procedures, and 7 problem-solving and conflict-resolution skills. 8 (2) A person who has attended previous training 9 conducted within 2 years before the election may be appointed 10 by the supervisor to fill a vacancy on election day. If no 11 person with prior training is available to fill such vacancy, 12 the supervisor of elections may fill such vacancy in 13 accordance with the provisions of subsection (3) from among 14 persons who have not received the training required by this 15 section. 16 (3) In the case of absence or refusal to act on the 17 part of any inspector or clerk at any precinct on the day of 18 an election, the supervisor shall appoint a replacement who 19 meets the qualifications prescribed in section 102.012(2). 20 The inspector or clerk so appointed shall be a member of the 21 same political party as the clerk or inspector whom he or she 22 replaces. 23 (4) Each supervisor of elections shall be responsible 24 for training inspectors and clerks, subject to the following 25 minimum requirements: 26 (a) Each clerk shall receive four hours of training 27 biannually when not in a general election year, and two hours 28 of training quarterly in each general election year; 29 (b) Each inspector shall receive at least two hours of 30 training biannually when not in a general election year, and 31 one hour of training quarterly in each general election year. 3 File original & 9 copies 04/23/01 hrc0001 04:14 pm 01925-0076-245775
HOUSE AMENDMENT Bill No. CS/HB 1925 Amendment No. ___ (for drafter's use only) 1 (c) No clerk shall be entitled to work at the polls 2 unless he or she has had a minimum of six hours of training. 3 (d) No inspector shall work at the polls unless he or 4 she has had a minimum of three hours of training. 5 (5) The Department of State shall create a uniform 6 polling place procedures manual and adopt the manual by rule. 7 Each supervisor of elections shall insure that the manual is 8 available in hard copy or electronic form in every precinct in 9 the supervisor's jurisdiction on election day. The manual 10 shall guide inspectors, clerks, and deputy sheriffs in the 11 proper implementation of election procedures and laws. The 12 manual shall be indexed by subject, and written in plain, 13 clear, unambiguous language. The manual shall provide 14 specific examples of common problems encountered at the polls 15 on election day, and detail specific procedures for resolving 16 those problems. The manual shall include, without limitation: 17 (a) Regulations governing solicitation by individuals 18 and groups at the polling place; 19 (b) Procedures to be followed with respect to voters 20 whose names are not on the precinct register; 21 (c) Proper operation of the voting system; 22 (d) Ballot handling procedures; 23 (e) Procedures governing spoiled ballots; 24 (f) Procedures to be followed after the polls close; 25 (g) Rights of voters at the polls; 26 (h) Procedures for handling emergency situations; 27 (i) Procedures for dealing with irate voters; 28 (j) The handling and processing of provisional 29 ballots; and 30 (k) Security procedures. 31 4 File original & 9 copies 04/23/01 hrc0001 04:14 pm 01925-0076-245775
HOUSE AMENDMENT Bill No. CS/HB 1925 Amendment No. ___ (for drafter's use only) 1 The Department of State shall revise the manual as necessary 2 to address new procedures in law or problems encountered by 3 voters and pollworkers at the precincts. 4 (6) Supervisors of elections shall work with the 5 business and local community to develop public-private 6 programs to ensure the recruitment of skilled inspectors and 7 clerks. 8 Section 53. Subsections (8) and (9) of section 9 102.012, Florida Statutes, are repealed. 10 Section 54. Subsection (2) of section 102.021, Florida 11 Statutes, is amended to read: 12 102.021 Compensation of inspectors, clerks, and deputy 13 sheriffs.-- 14 (2) Inspectors and clerks of election and deputy 15 sheriffs serving at the precincts may receive compensation and 16 travel expenses, as provided in s. 112.061, for attending the 17 pollworker training required by s. 102.014 102.012 (8). 18 19 20 ================ T I T L E A M E N D M E N T =============== 21 And the title is amended as follows: 22 On page 5, line 2 23 24 insert: 25 amending s. 98.255, F.S.; providing for 26 nonpartisan voter education; requiring the 27 supervisors of elections to report to the 28 Division of Elections on voter-education 29 programs; requiring the division to report to 30 the Legislature on the effectiveness of 31 voter-education programs; creating s. 5 File original & 9 copies 04/23/01 hrc0001 04:14 pm 01925-0076-245775
