  1                      A bill to be entitled

  2         An act relating to public records; amending s.

  3         98.0975, F.S.; providing that information

  4         contained in the central voter file

  5         administered by the Division of Elections of

  6         the Department of State is privileged and

  7         confidential; providing for future review and

  8         repeal; providing a legislative finding of

  9         public necessity; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Subsection (5) is added to section 98.0975,

14  Florida Statutes, to read:

15         98.0975  Central voter file; periodic list

16  maintenance.--

17         (5)  The information contained in the central voter

18  file is confidential and exempt from s. 119.07(1) and s.

19  24(a), Art. I of the State Constitution. This subsection is

20  subject to the Open Government Sunset Review Act of 1995 in

21  accordance with s. 119.15, and shall stand repealed October 2,

22  2006, unless reviewed and saved from repeal through

23  reenactment by the Legislature.

24         Section 2.  The Legislature finds that the exemption

25  from public records requirements provided in section

26  98.0975(5), Florida Statutes, is a public necessity, and that

27  it would be an invasion of a person's privacy for personal,

28  sensitive information contained in the central voter file to

29  be publicly available.

30         Section 3.  This act shall take effect July 1, 2001.
