17         Section 1.  (1)  Paragraphs (b) and (c) of subsection
18  (1) of section 206.9825, Florida Statutes, are amended to
19  read:
20         206.9825  Aviation fuel tax.--
21         (1)
22         (b)  Any licensed wholesaler or terminal supplier that
23  delivers aviation fuel to an air carrier offering
24  transcontinental jet service and that, after January 1, 1996,
25  increases the air carrier's Florida workforce by more than
26  1000 percent and by 250 or more full-time equivalent employee
27  positions, may receive a credit or refund as the ultimate
28  vendor of the aviation fuel for the 6.9 cents excise tax
29  previously paid, provided that the air carrier has no facility
30  for fueling highway vehicles from the tank in which the
31  aviation fuel is stored.  In calculating the new or additional

HOUSE AMENDMENT hbd-05 Bill No. HB 1983 Amendment No. ___ (for drafter's use only) 1 Florida full-time equivalent employee positions, any full-time 2 equivalent employee positions of parent or subsidiary 3 corporations which existed before January 1, 1996, shall not 4 be counted toward reaching the Florida employment increase 5 thresholds. The refund allowed under this paragraph is in 6 furtherance of the goals and policies of the State 7 Comprehensive Plan set forth in s. 187.201(17)(a), (b)1., 2., 8 (18)(a), (b)1., 4., (20)(a), (b)5., (22)(a), (b)1., 2., 4., 9 7., 9., and 12. This paragraph will expire on July 1, 2001. 10 (c) If, before July 1, 2001, the number of full-time 11 equivalent employee positions created or added to the air 12 carrier's Florida workforce falls below 250, the exemption 13 granted pursuant to this section shall not apply during the 14 period in which the air carrier has fewer than the 250 15 additional employees. 16 (2) This section shall take effect upon this act 17 becoming a law. 18 19 20 ================ T I T L E A M E N D M E N T =============== 21 And the title is amended as follows: 22 On page 1, lines 2 and 3, 23 remove from the title of the bill: all of said lines 24 25 and insert in lieu thereof: 26 An act relating to taxation; amending s. 27 206.9825, F.S.; removing the expiration date of 28 provisions which allow any licensed wholesaler 29 or terminal supplier that delivers aviation 30 fuel to certain air carriers to receive a 31 credit or refund of the aviation fuel tax under 2 File original & 9 copies 05/02/01 hbd0007 10:33 am 01983-0045-630021
