14 On page 2, between lines 4 and 5 of the bill

16 insert:
17 Section 2. Section 318.21, Florida Statutes, is
18 amended to read:
19 318.21 Disposition of civil penalties by county
20 courts.--All civil penalties received by a county court
21 pursuant to the provisions of this chapter shall be
22 distributed and paid monthly as follows:
23 (13)(a) A municipality or county may, by majority vote
24 of the governing board of the municipality or county, impose a
25 surcharge on the amount of civil penalties required under s.
26 318.18 for traffic infractions for the purposes of funding
27 residential traffic calming programs, crossing guards in
28 school zones, and police monitoring in school zones. The
29 surcharge may not be levied on traffic infractions occurring
30 on interstate highways. The surcharge must be authorized by
31 ordinance requiring public hearings and shall not be more than

2 (b) The proceeds of this surcharge must be placed in
3 a separate account established by the governing body of the
4 municipality or county and must be distributed quarterly to
5 fund residential traffic calming programs, crossing guards in
6 school zones, and police monitoring in school zones.
7 (c) This subsection shall not apply to counties with
8 a population of less than 1 million.

13 On page 1, lines 2-10
14 remove from the title of the bill: all of said lines

16 and insert in lieu thereof:
17 An act relating to civil traffic infractions;
18 amending s. 318.21, F.S.; revising language
19 with respect to a fee distributed to the
20 counties from each moving traffic violation to
21 be used for participation in an
22 intergovernmental radio communications program;
23 providing for the use of such funds under
24 certain circumstances; authorizing
25 municipalities and counties to impose a
26 surcharge on civil penalties for traffic
27 infractions to fund traffic control and safety
28 programs; prohibiting the levying of said
29 surcharge on traffic infractions occurring on
30 interstate highways; requiring the proceeds
31 from such surcharge to be deposited in a
