2 An act relating to disposition of civil
3 penalties; amending s. 318.21, F.S.; revising
4 language with respect to a fee distributed to
5 the counties from each moving traffic violation
6 to be used for participation in an
7 intergovernmental radio communication program;
8 providing for the use of such funds under
9 certain circumstances; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (10) of section 318.21, Florida
15 Statutes, is amended to read:
16 318.21 Disposition of civil penalties by county
17 courts.--All civil penalties received by a county court
18 pursuant to the provisions of this chapter shall be
19 distributed and paid monthly as follows:
20 (10) Twelve dollars and fifty cents from each moving
21 traffic violation must be used by the county to fund that
22 county's participation in an intergovernmental radio
23 communication program approved by the Department of Management
24 Services. If the county is not participating in such a
25 program, or if a municipality within the county has, pursuant
26 to s. 218.503, in the preceding 5 years been declared in a
27 state of financial emergency and has had a financial
28 emergencies board established, regardless of whether the board
29 is currently in existence, and maintains a radio-communication
30 program independent of the county, funds collected must be
31 used to fund local law enforcement automation and must be

1 distributed to the municipality or special improvement
2 district in which the violation occurred or to the county if
3 the violation occurred within the unincorporated area of the
4 county.
5 Section 2. This act shall take effect July 1, 2001.

Revises a provision of law which sets aside twelve
10 dollars and fifty cents from each moving traffic
violation in a county to fund that county's participation
11 in an intergovernmental radio communication program.
Provides that if the county is not participating in such
12 a program, or if a municipality maintains a radio
communication program independent of the county, funds
13 collected must be used to fund local enforcement
automation and must be distributed to the municipality or
14 special improvement district in which the violation
occurred or to the county if the violation occurred
15 within the unincorporated area of the county.
