12  recommended the following amendment:

14         Senate Amendment (with title amendment) 
15         On page 171, between lines 29 and 30,
16  
17  insert:  
18         Section 133.  Subsection (7) of section 125.0104,
19  Florida Statutes, is amended to read:
20         125.0104  Tourist development tax; procedure for
21  levying; authorized uses; referendum; enforcement.--
22         (7)  AUTOMATIC EXPIRATION ON RETIREMENT OF
23  BONDS.--Anything in this section to the contrary
24  notwithstanding, if the plan for tourist development approved
25  by the governing board of the county, as amended from time to
26  time pursuant to paragraph (4)(d), includes the acquisition,
27  construction, extension, enlargement, remodeling, repair, or
28  improvement of a publicly owned and operated convention
29  center, sports stadium, sports arena, coliseum, or auditorium,
30  or a museum that is publicly owned and operated or owned and
31  operated by a not-for-profit organization, the county

SENATE AMENDMENT Bill No. SB 2022 Amendment No. 5 Barcode 600104 1 ordinance levying and imposing the tax shall automatically 2 expire upon the later of: 3 (a) Retirement of all bonds issued by the county for 4 financing the same; or 5 (b) The expiration of any agreement by the county for 6 the operation or maintenance, or both, of a publicly owned and 7 operated convention center, sports stadium, sports arena, 8 coliseum, auditorium, or museum. However, nothing herein shall 9 preclude that county from amending the ordinance extending the 10 tax to the extent that the board of the county determines to 11 be necessary to provide funds with which to operate, maintain, 12 repair, or renew and replace a publicly owned and operated 13 convention center, sports stadium, sports arena, coliseum, 14 auditorium, or museum or from enacting an ordinance that shall 15 take effect without referendum approval pursuant to the 16 provisions of this section reimposing a tourist development 17 tax, upon or following the expiration of the previous 18 ordinance. 19 20 (Redesignate subsequent sections.) 21 22 23 ================ T I T L E A M E N D M E N T =============== 24 And the title is amended as follows: 25 On page 11, line 25, following the semicolon 26 27 insert: 28 amending s. 125.0104, F.S.; providing for 29 reimposition of a tourist development tax 30 without referendum approval under certain 31 conditions; 2 9:30 PM 04/17/01 s2022.go.05
