13         Senate Amendment (with title amendment) 
14         On page 43, between lines 4 and 5,
15  
16  insert:  
17         Section 26.  Section 372.635, Florida Statutes, is
18  created to read:
19         372.635  Illegal molestations or theft from freshwater
20  traps, nets or buoys.--
21         (1)  It is a felony of the third degree, punishable as
22  provided in s. 775.082, s. 775.083, or s. 775.084, for any
23  person, firm, or corporation to:
24         (a)  Willfully molest any authorized and lawfully
25  permitted freshwater traps, nets, lines or buoys, belonging to
26  another, without the express written consent of the trap or
27  net owner, available for immediate inspection; or
28         (b)  Willfully remove the contents of any authorized
29  and lawfully permitted freshwater traps or nets belonging to
30  another, without the express written consent of the trap or
31  net owner, available for immediate inspection.

SENATE AMENDMENT Bill No. CS for SB 2024 Amendment No. ___ Barcode 395910 1 (2) A person convicted of removing the contents of a 2 freshwater trap shall permanently lose his or her freshwater 3 and saltwater fishing privileges, including recreational and 4 commercial licenses and endorsements. In addition, any person, 5 firm, or corporation convicted of violating this subsection 6 shall also be assessed an administrative penalty of up to 7 $5,000.
