17  and insert in lieu thereof:

18         Section 7.  This section shall take effect October 1,

19  2001.

20         Each county or municipal public library that makes

21  available for public use computer on-line service, Internet

22  service, or local bulletin-board service shall install and

23  maintain computer software or equivalent technology on any

24  computer that is made available to persons under 18 years of

25  age which prohibits access to materials that contain obscene

26  descriptions, photographs, or depictions. If the library has

27  only one computer available for public use, the installation

28  of such software or technology shall be within the discretion

29  of the library.

30         Section 8.  In accordance with section 18, Article VII

31  of the State Constitution, the Legislature finds that the

  1  installation and maintenance by public libraries of computer

  2  software or equivalent technology that prohibits access by

  3  persons under 18 years of age to obscene materials fulfills an

  4  important state interest.

  5         Section 9.  Except as otherwise provided, this act

  6  shall take effect July 1, 2001.

10  And the title is amended as follows:

11         On page 1, line 18

12  remove from the title of the bill:  all of said line

13

14  and insert in lieu thereof:

15         requiring public libraries to install and

16         maintain computer software or equivalent

17         technology that prohibits access to obscene

18         materials by minors; providing that the

19         installation of software or technology in a

20         library having only one public-access computer

21         is within the library's discretion; providing a

22         finding of important state interest; providing

23         effective dates.
