15         On page 151, between lines 25 and 26,

17  insert:  
18         Section 104.  Subsection (4) is added to section
19  526.304, Florida Statutes, to read:
20         526.304  Predatory practices unlawful; exceptions.--
21         (4)  Notwithstanding any other provision of law to the
22  contrary, in determining whether the sale of motor fuel at a
23  retail outlet is unlawful under this section, the retail sale
24  shall be deemed to be made at the posted pump price, exclusive
25  of any discount received by the purchaser through an in-store
26  retail sales promotion, or that is conditioned upon a required
27  purchase or upon the method or manner of payment, including
28  through the use of a credit card, debit card, or special
29  discount card. Nothing in this subsection, however, authorizes
30  any activity or conduct that would otherwise be unlawful under
31  the antitrust laws of this state or the United States.
