2 An act relating to final disposition of a body;
3 amending s. 470.002, F.S.; redefining the term
4 "legally authorized person" for purposes of ch.
5 470, F.S.; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Subsection (18) of section 470.002, Florida
10 Statutes, is amended to read:
11 470.002 Definitions.--As used in this chapter:
12 (18) "Legally authorized person" means, in the
13 priority listed, the decedent, when written inter vivos
14 authorizations and directions are provided by the decedent,
15 the surviving spouse, unless the spouse has been arrested for
16 committing against the deceased an act of violence as defined
17 in s. 471.28(1), son or daughter who is 18 years of age or
18 older, parent, brother or sister 18 years of age or over,
19 grandchild who is 18 years of age or older, or grandparent; or
20 any person in the next degree of kinship. In addition, the
21 term may include, if no family exists or is available, the
22 following: the guardian of the dead person at the time of
23 death; the personal representative of the deceased; the
24 attorney in fact of the dead person at the time of death; the
25 health surrogate of the dead person at the time of death; a
26 public health officer; the medical examiner, county commission
27 or administrator acting under chapter 245, or other public
28 administrator; a representative of a nursing home or other
29 health care institution in charge of final disposition; or a
30 friend or other person not listed in this subsection who is
31 willing to assume the responsibility as authorized person.

1 Section 2. This act shall take effect July 1, 2001.

4 SENATE SUMMARY
5 Redefines the term "legally authorized person," for
purpose of final disposition of a body, to exclude the
6 spouse of a deceased when the spouse has been arrested
for committing against the deceased an act of domestic
7 violence.
