11  The Committee on Health, Aging and Long-Term Care recommended
12  the following amendment:

14         Senate Amendment 
15         On page 6, line 5, after the period,
16  
17  insert:  The Legislature finds that the risk-based capital
18  reports provide early warning signs that may necessitate
19  corrective action before serious financial problems arise and
20  such activity is a public benefit. Providing confidentiality
21  to such records and proceedings enables the health maintenance
22  organizations to reduce risk to members of the health
23  maintenance organization and encourages the health maintenance
24  organization to be more open and frank in the information so
25  provided, without the attendant fear that honest and truthful
26  exchange of information will result in the public
27  dissemination of information that could be used to harm the
28  health maintenance organization and its members.
