  2         An act relating to fictitious-name

  3         registration; amending s. 865.09, F.S.;

  4         providing for notification to the Division of

  5         Corporations of the Department of State of

  6         certain information when a business location

  7         changes; providing for forms; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsections (4) and (11) of section 865.09,

13  Florida Statutes, are amended to read:

14         865.09  Fictitious name registration.--

15         (4)  CHANGE OF OWNERSHIP.--

16         (a)  If the ownership of a business registered under

17  this section changes, the owner of record with the division

18  shall file a cancellation and reregistration that meets the

19  requirements set forth in subsection (3) within 30 days after

20  the occurrence of such change.

21         (b)  If the location of a business registered under

22  this section changes, the owner of record with the division,

23  within 30 days after the occurrence of such change, shall

24  notify the division of the address at the new location and

25  shall advertise the business name and new address at least

26  once in a newspaper as defined in chapter 50 in the county

27  where the business will be located.

28         (11)  FORMS.--Registration, cancellation, and renewal

29  shall be made on forms prescribed by the Department of State,

30  which may include the uniform business report, pursuant to s.

  2  chapter part.

  3         Section 2.  This act shall take effect July 1, 2001.

  6                          SENATE SUMMARY

  7    Requires the owner of record of a business registered
      with the Division of Corporations of the Department of
  8    State under the fictitious-name statute to notify the
      division within 30 days after a change of address of the
  9    business and advertise the new address at least once in
      the newspaper in the county where the business will be
10    located.
