  1                      A bill to be entitled

  2         An act relating to elections; creating s.

  3         101.72, F.S.; providing for a Voter's Bill of

  4         Rights; providing responsibilities of

  5         supervisors of elections; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Section 101.72, Florida Statutes, is

11  created to read:

12         101.72  Voter's Bill of Rights.--

13         (1)  The supervisor of elections in each county shall

14  have posted at each polling place in the county a Voter's Bill

15  of Rights in the following form:

16                      VOTER'S BILL OF RIGHTS

17         Each registered voter in this state has the right to:

18         1.  Vote and have his or her vote accurately counted.

19         2.  Cast a vote if he or she is in line when the polls

20  are closing.

21         3.  Ask for and receive assistance in voting.

22         4.  A replacement ballot if he or she has voted in

23  error.

24         5.  An explanation if his or her registration is in

25  question.

26         6.  If his or her registration is in question, cast a

27  provisional ballot.

28         7.  Prove his or her identity by signing an affidavit

29  if election officials doubt the voter's identity.

30         8.  Written instructions to use when voting, and, upon

31  request, oral instructions in voting from elections officers.

  1         9.  Vote free from coercion or intimidation by

  2  elections officers or any other person.

  3         10.  Vote on a voting machine that is in working

  4  condition and that will allow votes to be accurately cast.

  5         (2)  The supervisor of elections shall have the Voter's

  6  Bill of Rights [printed in a large font and in English and

  7  where applicable in Spanish and Creole] and make it available

  8  at each polling place in the form of a handbill so that voters

  9  may individually review their rights.

10         Section 2.  This act shall take effect October 1, 2001.

13                          SENATE SUMMARY

14    Creates a Voter's Bill of Rights. Provides for display
      and distribution. Prescribes responsibilities of the
15    supervisors of elections in making the Voter's Bill of
      Rights available to and viewable by the public.
