  1                      A bill to be entitled

  2         An act relating to hiring or leasing with

  3         intent to defraud; amending s. 812.155, F.S.;

  4         providing that the exclusion of property

  5         obtained under a rental-purchase agreement from

  6         criminal statutes relating to hiring or leasing

  7         with intent to defraud and similar offenses

  8         does not apply when the rental store retains

  9         title to the property through the period of the

10         agreement; providing penalties; providing an

11         effective date.

13  Be It Enacted by the Legislature of the State of Florida:

15         Section 1.  Subsection (7) of section 812.155, Florida

16  Statutes, is amended to read:

17         812.155  Hiring, leasing, or obtaining personal

18  property or equipment with the intent to defraud; failing to

19  return hired or leased personal property or equipment; rules

20  of evidence.--

21         (7)  EXCLUSION OF RENTAL-PURCHASE AGREEMENTS.--This

22  section does not apply to personal property or equipment that

23  is the subject of a rental-purchase agreement that permits the

24  lessee to acquire ownership of the personal property or

25  equipment unless the rental store retains title to the

26  property throughout the rental-purchase agreement period.

27         Section 2.  This act shall take effect July 1, 2001.

      trick, false representation, etc.; hiring or leasing with

      leased property to property that is the subject of a
