13         Senate Amendment (with title amendment) 
14         On page 93, line 31,

16  insert:  
17         Section 35.  Subsection (2) of section 768.28, Florida
18  Statutes, is amended to read:
19         768.28  Waiver of sovereign immunity in tort actions;
20  recovery limits; limitation on attorney fees; statute of
21  limitations; exclusions; indemnification; risk management
22  programs.--
23         (2)  As used in this act, "state agencies or
24  subdivisions" include the executive departments, the
25  Legislature, the judicial branch (including public defenders),
26  and the independent establishments of the state; counties and
27  municipalities; state university boards of trustees; and
28  corporations primarily acting as instrumentalities or agencies
29  of the state, counties, or municipalities, including the
30  Spaceport Florida Authority.
