  1                      A bill to be entitled

  2         An act relating to motor vehicles; amending s.

  3         320.084, F.S.; allowing certain disabled

  4         veterans to purchase additional disabled

  5         veterans license plates; amending s. 320.0848,

  6         F.S.; authorizing certain additional health

  7         care professionals to issue certifications of

  8         disability; providing an effective date.

  9

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (6) is added to section 320.084,

13  Florida Statutes, to read:

14         320.084  Free motor vehicle license plate to certain

15  disabled veterans.--

16         (6)  A disabled veteran who has received a free license

17  plate under this section may purchase additional disabled

18  veterans license plates. The cost for additional plates may

19  not exceed the cost provided in s. 320.06(1)(b).

20         Section 2.  Paragraphs (a) and (b) of subsection (1) of

21  section 320.0848, Florida Statutes, are amended to read:

22         320.0848  Persons who have disabilities; issuance of

23  disabled parking permits; temporary permits; permits for

24  certain providers of transportation services to persons who

25  have disabilities.--

26         (1)(a)  The Department of Highway Safety and Motor

27  Vehicles or its authorized agents shall, upon application and

28  receipt of the fee, issue a disabled parking permit for a

29  period of up to 4 years, which period ends on the applicant's

30  birthday, to any person who has long-term mobility impairment,

  1  or a temporary disabled parking permit not to exceed 1 year to

  2  any person who has a temporary mobility impairment.

  3         (b)1.  The person must be currently certified as being

  4  legally blind or as having any of the following disabilities

  5  that render him or her unable to walk 200 feet without

  6  stopping to rest:

  7         a.  Inability to walk without the use of or assistance

  8  from a brace, cane, crutch, prosthetic device, or other

  9  assistive device, or without the assistance of another person.

10  If the assistive device significantly restores the person's

11  ability to walk to the extent that the person can walk without

12  severe limitation, the person is not eligible for the

13  exemption parking permit.

14         b.  The need to permanently use a wheelchair.

15         c.  Restriction by lung disease to the extent that the

16  person's forced (respiratory) expiratory volume for 1 second,

17  when measured by spirometry, is less than 1 liter, or the

18  person's arterial oxygen is less than 60 mm/hg on room air at

19  rest.

20         d.  Use of portable oxygen.

21         e.  Restriction by cardiac condition to the extent that

22  the person's functional limitations are classified in severity

23  as Class III or Class IV according to standards set by the

24  American Heart Association.

25         f.  Severe limitation in the person's ability to walk

26  due to an arthritic, neurological, or orthopedic condition.

27         2.  The certification of disability which is required

28  under subparagraph 1. must be provided by a physician licensed

29  under chapter 458, chapter 459, or chapter 460, by a podiatric

30  physician licensed under chapter 461, by an optometrist

31  licensed under chapter 463, by the Adjudication Office of the

  1  United States Department of Veterans Affairs or its

  2  predecessor, or by a similarly licensed physician from another

  3  state if the application is accompanied by documentation of

  4  the physician's licensure in the other state and a form signed

  5  by the out-of-state physician verifying his or her knowledge

  6  of this state's eligibility guidelines, by an advanced

  7  registered nurse practitioner licensed under chapter 464 in a

  8  facility operated by the United States Department of Veterans

  9  Affairs under the protocol of a licensed physician, or by a

10  physician assistant licensed under chapter 458 or chapter 459

11  in a facility operated by the United States Department of

12  Veterans Affairs.

13         Section 3.  This act shall take effect July 1, 2001.

16                          SENATE SUMMARY

17    Provides for certain disabled veterans to purchase
      additional disabled license plates. Provides for advanced
18    nurse practitioners and physician assistants employed by
      the United States Department of Veterans Affairs to
19    certify disabilities.
