1 A bill to be entitled
2 An act relating to public records; amending s.
3 110.201, F.S.; providing a public-records
4 exemption for certain state employees' records;
5 providing a finding of public necessity and an
6 expiration date; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (6) is added to section 110.201,
11 Florida Statutes, to read:
12 110.201 Personnel rules, records, and reports.--
13 (6) The names, personal addresses, and social security
14 numbers of state employees are confidential and exempt from
15 the provisions of s. 119.07(1) to the extent that a state
16 governmental agency may not provide the names or addresses of
17 such persons in aggregate, compiled, or list form to any
18 person except to a public agency engaged in official business.
19 However, a state government agency may provide the names and
20 personal addresses of state employees to a bargaining agent as
21 defined in s. 447.203(12). Lists of names, personal addresses,
22 or social security numbers of state employees may be exchanged
23 by public agencies, but such lists may not be provided to, or
24 be open for inspection by, the public. Any person may view or
25 copy any individual's records from an agency, one record at a
26 time, or may obtain information by a separate written request
27 concerning a named individual for which information is
28 desired. This exemption is subject to the Open Government
29 Sunset Review Act in accordance with s. 119.15 and expires on
30 October 2, 2006, unless reviewed and reenacted by the
31 Legislature.

1 Section 2. The Legislature finds that it is a public
2 necessity that the names, personal addresses, and social
3 security numbers of state employees be held confidential in
4 order to protect the employee's right to privacy under Section
5 23 of Article I of the State Constitution.
6 Section 3. This act shall take effect July 1, 2001.
