3 insurance and prescription drug programs;
4 authorizing school districts to apply for
5 participation; providing eligibility
6 requirements for enrollment; exempting the
7 program from ss. 624.436-624.446, F.S.,
8 relating to multiple-employer welfare
9 arrangements; authorizing the Department of
10 Management Services to adopt rules; providing a
11 conditional effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Section 110.1228, Florida Statutes, is
16 created to read:
17 110.1228 Participation by district school systems.--
18 (1) As used in this section, the term "district school
19 system" means a district unit as defined under s. 230.01.
20 (2) A district school system may apply for
21 participation in the state group health insurance program
22 authorized under s. 110.123 and the prescription drug coverage
23 program authorized under s. 100.12315 by submitting to the
24 department an application, together with a $500 nonrefundable
25 fee.
26 (3) As a prerequisite to applying for participation in
27 the state group health insurance program and the prescription
28 drug coverage program, a district school board must adopt an
29 ordinance or resolution ratifying such an application to the
30 state group health insurance program and the prescription drug
31 coverage program.

1 (4) If the department determines that a district
2 school board is eligible to enroll, the district school board
3 must agree to the following terms and conditions:
4 (a) The minimum enrollment or contractual period will
5 be 3 years.
6 (b) The district school board must pay to the
7 department a monthly administrative fee per enrollee per
8 month.
9 (c) Termination of participation of a district school
10 board requires written notice 1 year before the termination
11 date.
12 (d) If participation is terminated, a district school
13 board may not reapply for participation for 2 years.
14 (e) If a district school board employer fails to make
15 the premium payment required by this chapter, the Department
16 of Revenue or the Department of Banking and Finance shall,
17 upon the request of the Department of Management Services,
18 deduct the amount owed by the employer from any funds to be
19 distributed by it to the district school board. The amounts so
20 deducted must be transferred to the department for further
21 distribution to the trust funds in accordance with this
22 chapter.
23 (f) The district school board shall furnish to the
24 department information requested by the department which the
25 department considers necessary to administering the state
26 group health insurance program and the prescription drug
27 program.
28 (5) Sections 624.436-624.446 do not apply to the State
29 Group Insurance Program or to this section.
30 (6) The Department of Management Services may adopt
31 rules necessary to administer this section.

1 Section 2. This act shall take effect upon becoming a
2 law if the Department of Management Services receives all
3 favorable letters necessary by that date. If the Department of
4 Management Services does not receive such favorable letters,
5 this act shall not take effect.
