11  The Committee on Comprehensive Planning, Local and Military
12  Affairs recommended the following amendment:
13  
14         Senate Amendment 
15         On page 3, lines 3 through 8, delete those lines
16  
17  and insert:  
18         Section 2.  The City of Vero Beach is authorized to
19  compensate Joseph Arvay, out of funds of the city not
20  otherwise appropriated, an amount not to exceed $4,349,094.48
21  which shall be paid pursuant to an amended Consent Final
22  Judgment described below. Before the city is authorized to
23  make any payments to Joseph Arvay, the Consent Final Judgment
24  entered on July 3, 2000 in the case of Joseph Arvay v. City of
25  Vero Beach, Case No. 94-0541 CA, 19th Judicial Circuit, in and
26  for Indian River County, shall be amended to: 1)  condition
27  any payments of cash to Mr. Arvay on the prior appointment of
28  a guardian of the property by the Circuit Court, 2)  delete
29  the requirement of paragraph 6 of the Consent Final Judgment
30  granting an inheritance to Mr. Arvay's daughters of up to
31  $75,000, and 3)  reduce the attorneys' fees payable under
